1962-0757RESOLUTION NO. 62R -757 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING CONDITIONAL USE PERMIT NO. 249. WHEREAS, the City Planning Commission of the City of Anaheim did receive a request for a Conditional Use Permit from BENJAMIN DABULIS, ET AL., 2504 Orange Avenue, Anaheim, California, to construct a one -story planned unit development on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: The westerly 90 feet of Lot 1 of Tract No. 796, the west 90 feet of Lot 3 of Tract No. 796, and the North 467 feet of Lot 1 in Block "A" of Tract No. 796, said tract being shown on a map recorded in Book 24, Page 28 of Miscellaneous Maps, records of Orange County, California. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said request on July 23, 1962, notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. 411, Series 1962 -63, denying Conditional Use Permit No. 249; and WHEREAS, thereafter, within twenty -two days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Planning Commission in denying said Conditional Use Permit and did thereupon fix the 21st day of August, 1962, as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing upon said Condi- tional Use Permit, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim. Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an oppor- tunity to be heard and did receive evidence and reports; and WHEREAS, the City Council does find, after careful consideration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that Conditional Use Permit No. 249 should be denied; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission denying Conditional Use Permit No. 249 be, and the same is hereby sustained, and that the request of -1- ATTEST: STATE OF CALIFORNIA COUNTY OF ORANGE ss.
