A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM DENYING CONDITIONAL USE
PERMIT NO. 268.
WHEREAS, the City Planning Commission of the City of
Anaheim did receive a request for a Conditional Use Permit from
Carl L. Rau, 923 West Center Street, Anaheim, California, to
establish a kennel for boarding, grooming and breeding of dogs
and cats on the following described property situated in the City
of Anaheim, County of Orange, State of California, to wit:
PARCEL 1.
Lot 1 of Tract No. 994, as shown on a Map recorded in
Book 33, page 8 of Miscellaneous Maps, records of Orange
County, California.
Excepting therefrom the Northerly 233.00 feet.
Also excepting therefrom that portion lying Easterly of
the Westerly line of the land described in a deed to the
Orange County Flood Control District recorded July 27,
1961 in Book 5796, page 991 of Official Records.
PARCEL 2.
The West half of that portion of Richard Street, 60.00
feet wide, as shown on a map of Tract No. 994, recorded
in Book 33, page 8 of Miscellaneous Maps, records of Orange
County, California, abandoned by Order of the Board of Super-
visors of Orange County, a certified copy of which order was
recorded November 9, 1946 in Book 1505, page 1112 of Official
Records, lying Southerly of the Easterly prolongation of the
Southerly line of the Northerly 233.00 feet of Lot 1 of said
Tract No. 994, and Northerly of the Easterly prolongation of
the Southerly line of said Lot 1.
Excepting therefrom that portion lying Easterly of the West-
erly line of the land described in a deed to the Orange
County Flood Control District, recorded July 27, 1961 in
Book 5796, page 991 of Official Records.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon
said request on July 9, 1962, notices of which said public
hearing were duly given as required by law and the provisions
of Title 16, Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, said Commission, after due inspection, in-
vestigation, and studies made by itself and in its behalf and
after due consideration of all evidence and reports offered at
said hearing, did adopt its Resolution No. 402, Series 1962 -63
denying Conditional Use Permit No. 268; and
WHEREAS, thereafter, within twenty -two days from the
date of adoption of said resolution, a written appeal was filed
with the City Council of the City of Anaheim protesting the
action of the City Planning Commission denying said Conditional
Use Permit, and said appeal was set for public hearing on
August 21, 1962, at 7:00 o'clock P.M. at the City Hall in the
City of Anaheim, and notice of such public hearing was duly
given as required by law and the provisions of Title 18,
Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such hear-
ing and did give all persons interested therein an opportunity
to be heard and did receive evidence and reports; and
WHEREAS, the City Council does find, after careful
consideration of the recommendations of the City Planning
Commission and all evidence and reports offered at said hearing,
that Conditional Use Permit No. 268 should be denied;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the action of the City Planning
Commission denying Conditional Use Permit No. 268 be, and the
same is hereby sustained, and that the request of Carl L. Rau,
923 West Center Street, Anaheim, California, for a Conditional
Use Permit to establish a kennel for boarding, grooming and
breeding of dogs and cats on the property hereinabove described
be, and the same is hereby, denied.
THE FOREGOING RESOLUTION is approved and signed by
me this 21st day of August, 1962.

AND I FURTHER CERTIFY that the Mayor of the City of

August, 1962.
