A BESOLU'l'ION OF THE CITY COUNCIL OF THE
CITY OF A.HABEIM AU'l'HORIZING THE Pu:RCH.A.SE
AID ACQUISITION OF CERTAIN REAL PROPERTY
FOR Pt:JBLIO PURPOSES.

hereinatter described real property situated. in the Oity ot
Anaheim, Oounty ot Orange, State of Cal1:tomia; an4
WHEREAS, said owner has ottered to sell sai4
property to the City ot Anaheim for the sum of $10,000.00,
cash, lawful money ot the United States; an4
WHEREAS, the City Oouncil does find and determine
that public convenience and necessity require the purchase
and acquisition of said parcel of real property for public
purposes, and that the price which the owner thereof i.
willing to accept is reasonable and not out of proportion
to the tair market value of sald property.

of the City ot Anaheim that the otter ot Lawrence John lelly
to sell said property, situated in the Oity of Anaheim,
County ot Orange, state ot California, described as follows,
to wit:

desoribed as tollows:
Beginning at the Southeast corner ot the South-
west t of the Northwest t of said Section; thence
Northerly along the Easterly line thereof 299."
feet; thence Westerly parallel with the South
line of said Southwest t, 121.53 feet; thence
at right angles Southerly 229.9S feet to said
South line; thence Easterly along said South
line 118.79 teet to the point of beginning.
Together with all rights to the well and pumping
plant located thereon,
for the .um of $10,000.00 oash, lawful money ot the United
States,be, and the same il hereby accepted, subject to the
following terms and conditions:
That subject property shall be conveyed to
the City of Anaheim free and olear of all
enoumbranoes, except all taxes tor the fiscal
year 1956-57, a lien not yet payable, and
oovenants, eonditlons, restrictions, reser-
vations, rights, rights-of-way and easements
of record..

BE IT FUR'fBER RESOLVED that the City Administrator
of the City ot Anaheim be, and he is hereby, authorized tor
and on behalf of the City ot Anaheim to sign escrow instruct-
ions for the purchase of said real property and to enter into
an escrow with the owner of said property at Orange Oounty
'fitle Company, 412 N. Main street, Santa Ana, California.

AND BE IT FURTHER RESOLVED that the City Treasurer
be, and she is hereby, authorized to deposit in escrow at
Orange County Title Company, 412 N. Main street, Santa Ana,
California, the sum of 110,000.00 cash, lawful money of the
United states, to be paid to the owner of said real property
when a deed conveying said property to the City of Anaheim
free and clear of all encumbrances, except as hereinabove set
forth, can be recorded and a policy of title insurance issued
by Orange County Title Company showing said property vested
in the City of Anaheim free and clear of all encumbranoes as
herein speoified.
.AND BE IT FUR'fHER RESOLVED that the seller shall
pay the usual and customary sellerls charges for furnishing
a policy of title insurance necessary to show title vested
in the City of Anaheim, as herein provided, and that the City
of Anaheim shall pay the usual buyer's share in the purchase
of said property.
THE FOREGOING RESOLUTION is signed and approved by
me this 22nd day of May, 1956.
