APPROVING AN AGREEj,iENT TO BE HADE ANti ].'NTERED INTO BY
AND BETWEEN THE STATE OF CALH'ORNIA,DEPARTMENT OF PUBLIC
WORKS, DIVISION OF HIGlfwAYS, AND THE CITY OF A<~AHEIM, AS
CONTRACTING AGENT FOR THE CITIES AI'ID SAi.'lITARY DISTRICTS
OF THE ORAi~GE COUNTY JOINT OUTF:\LL SEWER, RELATING TO THE
llAGNOLIA AVENUE OVERHEAD ON THE SANTA ANA FREEWAY, ACROSS
THE SOUTHE.Ri1J PACIFIC COHPAlIT TRACKS AND RIGHT-OF-WAY.
WHEREAS, the State of California, Department of Public Works,
Division of Highways, proposes the construction of State Route VII-Ora-174-
Ana at Magnolia Avenue overhead on the Santa Ana Freeway, across the Southern
Pacific Company tracks and right-of-way; and
\~REAS, in order to complete said proposed construction, it is
necessary to relocate the trunk sewer line of the Joint County Outfall Sewer,
and it is necessary that a grant of easement be obtained from the Southern
Pacific Co~pany granting to said City of Anaheim, as contracting agent of the
cities and salutary districts of the Joint Outfall Sewer, an easement for the
relocation, construction and maintenance of said trunk sewer line across
property of said Southern Pacific Company; and
,iHE:ci.EAS, the Southern Pacific Company, a corporation of the State of
Delaware, has tendered to the City of Anaheim, as such contracting agent, an
indenture dated the 15th day of Febr~lary, 1956, granting to the City of Anaheim,
as such contracting ager~, the richt to construct, reconstruct, maintain and
use a sewer line in and along that portion of Section 6, Township 4 South, Range
10 i'iest, 3.3.3. & ]vI., in Rancho San Juan Cajon de Sal1ta Ana, Orange County,
California, as more particularly described in said Agreement; and
\'lHEREAS, said grant of easement tendered to the City of AneJ1eim, as
such contracting agent, is proposed to be granted upon the terms and conditions
set forth i.n said indenture of Februa.ry 15, 1956 above referred to; Flld
\fHEREAS, the State of Calif orn',-a, Department of Public Works,
Division of Highways has requested the City of Anaheim, as such contracting
agent, to sign said indenture of February- 15, 1956 &'1d has offered to enter
into an agreement with the City of Anac'lejjll, as such contracting agent, agree-
ing to comply with all of the terrns and conditions of said grant of easement,
and particularly Paragraphs 3, 4, 5, 6 and 7.
NOH, THEEEFORE, BE IT RESOLVED, by the City Council of the City of
AnaQeim that the proposed Agreement, dated the 16th day of May, 1956, to be
made and entered into by and between the State of California, Department of
Public WOl'ks, Div'.Lsion of Fiighwa~rs and the City of Anaheim, as contracting
Agent for the cities of Ana11eim, Fullerton, Orange and Buena Park and for the
Sanitary Dj~stricts of Garden Grove, La Babra and Placentia, owners of the
Orange County Joint Outfall Sewer, relatinE; to the construction of said Route
VII-Ora-17!i-Ana at J'1agnolia Avenue overhead on the Santa Ana Freeway, across
the Southern Pacific Company tracks and ric::ht-of-way be, and the same is hereby,
approved and 'Ghat the Hayar and the City CJe rk be, and they are hereby, author-
ized to execu-te said A:;ree"'ent for and on behalf of the City of Anac'leim, as
