1962-0713RESOLUTION NO. 62R -713 A RESOLUTION OF THE CITY cOUNCIL OF THE CITY OF ANAHEIM DENYING CONDITIONAL USE PERMIT NO. 225. WHEREAS, the City Planning Commission of the City of Anaheim did receive a request for a Conditional Use Permit from THOMAS A. BEYRLE, 5022 Triggs Street, Los Angeles 22, California, to establish a restaurant, banquet room, conference rooms and a 100 -unit motel on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: The East 155 feet of the West 165 feet of that portion of Lot 2 in Block K of the Kraemer Tract, as shown on a Map recorded in Book 12, Pages 87 and 88 of Miscellaneous Records of Los Angeles County, California, described as follows: Beginning at a point in the Easterly line of said Lot, 28 chains Southerly from the North- easterly corner of said lot; thence Southerly along said Easterly line, 12.03 chains to the Southeasterly corner of said lot; thence West- erly along the Southerly line of said lot, 20 chains to the Southwesterly corner of said lot, 12.03 chains to the Southwesterly corner of the tract of land described in the deed from MATTIE GOETZ and husband to EMMA SHAFFER, recorded December 6, 1917 in Book 316, Page 202 of Deeds; thence Easterly along the Southerly line of said tract 20 chains to the point of beginning. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said request on June 11, 1962, notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. 346, Series 1961 -62 granting Conditional Use Permit No. 225, upon the conditions therein set forth; and WHEREAS, thereafter, within twenty -two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Planning Commission in granting said Conditional Use Permit and did thereupon fix the 24th day of July, 1962, as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing upon said Conditional Use Permit, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing -1- A ;ST: and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did defer action on said Conditional Use Permit for one week; and WHEREAS, the City Council does find, after careful consideration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that Conditional Use Permit No. 225 should be denied. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission granting Conditional Use Permit No. 225 be, and the same is hereby, disapproved and that the request of THOMAS A. BEYRLE, 5022 Triggs Street, Los Angeles 22, California, for a Conditional Use Permit to establish a restaurant, banquet room, conference rooms and a 100 -unit motel on the property herein above described be, and the same is hereby, denied THE FOREGOING RESOLUTION is approved and signed by me this 31st day of July, 1962.
