56R-3243 -- ,...... , RESOLUTION NO. 3243 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF' ANAHEH1 ACCEPTING 'I'HE O,lF'ER OF E. D. JOHNSON AND COMPANY TO F~RNISH ALL LABOR AND EQUIPI0ENT TO INS'fALL PRIHARY A.ND SECONDARY ELECTRICAL DISTRIBUTION FACILITIES IN TRACTS NOS. 2491 and 2492, WORK ORDER NO. 241-1-5; AND AUTHORIZING THE EXECUTION OF AN AGREEMENT TO BE MADE AND ENTERED INTO WITH SAID E. D. JOHNSON AND COMPANY. WHEREAS, the City Council does find and determine that public convenience and necessity require the installa- tion of primary and secondary electrical distribution faoil- ities, consisting of pole lines, cross-arms, secondary racks, insulators, transformers, fuse cut-outs, etc., in Tracts Nos. 2491 and 2492, Work Order No. 2445; and WHEREAS, E. D. Johnson a nd Company has offered to furnish all labor and equipment to install said primary and secondary electrical distribution facilities in accordance with the design, plans, profiles, drawings and/or specifi- cations prepared by the Superintendent of the Light, Power and Water Department of the City of Anaheim, and to install the same wi thin twenty-one (21) Horldng days from and after the execution of a contract to be made and entered into by and between E. D. Johnson and Company and the City, for the price of $4,984.00; and WHEREAS, the City Council finds that said price is the lowest obtainable for the furnishing of all labor and equipment to install said electrical distribution facilities, and that the offer of E. D. Johnson and Company should be accepted upon the conditions hereinafter set forth. NOW, THEHEFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the offer of E. D. Johnson and Company to furnish all labor and equipment to install primary and secondary electrical distribution facilities, consisting of pole lines, cross-arms, secondary racks, insulators, trans- formers, fuse cut-outs, etc., in Tracts Nos. 2491 and 2492, Work Order No. 2445, in accordance with the design, plans, profiles, drawings and/or specifications prepared by the Superintendent of the Light, POHer and Water Department of the City of Anaheim, be, and the same is hereby, accepted, upon the following conditions: 1. That all labor and equipment shall be furnished and the installation of said electrical distribution facilities com- pleted within Twenty-one (21) working days from and aftel" the execution of a contract to be made and entered into by and between E. That in the furnishing of all labor and equipment for the installation of said electrical distribution facilities it shall be expressly understood and agreed that said E. D. Johnson and Company is acting as an independent contractor and not as an agent, servant or employee of the City of Anaheim. AND BE IT PURTHER RESOLVED that t he purchase price for the furnishing of all of said labor and equipment for the installation and completion of said public improvement above described shall be paid to E. D. Johnson and Company as follows: 83% thereof upon the completion and acceptance of said work, and the remaining 15% thereof thirty- five (5) days after the filing of notice of com- pletion of sa;Ld improve!cent by the City of Anaheim. 3E IT l~RTHER RESOLVED that said E. D. Johnson and Company shall carry public liability and property damage in- surance in an amount not less than ;,;,100,000.00 for injuries, includins accidental death, for anyone person, and subject to the same limit :Cor each person in an amount not less than ~300,000.00 on account of anyone accident, ~nd property damage insurance in an amount not less than $50,000.00; and shall take out and maintain durincj the life of said contract workments compensation insurance covering all of its employees on the project; and public liability and property damage in- sur'anee to cover vehicles used or maintained by it in the performance of said work connected.with said improvement, with liabilitylimits of not less than 'IP50,000.00 for anyone per- son, and ~plOO,OOO.OO for anyone accident, and property damage of ~nO,OOO.OO. That said E. D. Johnson and Company shall also fur- nish a Pai thful Performance Bond, and a Labor and M.aterial Bond for 100/~ of the cost of said publiC improvement.
