A RESOLUTIO;~ OF Till; CITY COUNCIL OF THE CITY OF
ANAHEIM AUTHORIZING THE ISSUANCE OF A PERPIIT TO
CONSTRUCT AND ~!AINTAIN A GATE OVER AND ACROSS A
DRAINAGE DITCH LOCATED ON THE HEREINAFTER DE-
SCRIBED PROPERTY.
wHEREAS, the City of Anaheim has an easement over Lot
142 of Tract 2093, in the City of Anaheim, County of Orange,
State of California, as per map filed in Book 76, Pages 46 and
47 of Miscellaneous Maps, records of Orange County, for the pur-
pose of drainage and there is constructed thereon a drainage
ditch; and
WHEREAS, the City Council of the City of Anaheim finds
that it would not restrict the use of said easement to allow the
owner of Lot 142 of Tract 2093 to place a gate over and across
said dreinage <litch, and that placing a gate across said drainage
ditch would not be against the public interest.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that a "Permit to Span Drainage Ditch," in
the form set out below, be issued to W. J. Eyestone of 1184 Brook-
hurst .Avenue, An['-J1eim, California, as owner of said Lot 142 of
Tract 2093.
PER.HT TO SPAN DRAINAGE DITCH
The City of Anaheim does hereby agree, pursuant to Resolution
No.3242 adopted by the City Council of the City of Anaheim
on the ~th day of April , 1956, to permit the owner of
Lot 142 0 Tract 2093, in the City of Anaheim, County of
Orange, state of California, as per map filed in Book 76,
Pag'es L,6 and 47 of Hiscellaneous Maps, records of Orange
County, to construct and maintain a gate over and across a
drainage ditch located on the above described property, and
to connect said gate into said ownerfs fence; PROVIDED that
said drainage ditch shall be kept and maintained by said
owner as directed by the City of Anaheim or its duly auth-
orized officials and that said drainage ditch shall be kept
accessible to the City of Anaheim, its employees and officials
at all times for any and all purposes 'l'lhatsoever.
This permit shall remain in force until revoked by the City
of Aaaheim and shall be transferrable with the property.
The City of Anaheim reserves the ric;ht to cancel this permit
at any time upon giving five days' written notice thereof
and upon the giving of said notice, the owner shall forth-
with remove said gate and restore said drainage ditch to
tieL! condition required. by the City of Anaheim, and should
sHid ovmer f~l i1 or refuse to remove sa.id gate and/or l'estore
the Qrainage ditch as reouired by the City of Anaheim, then
said City of Analleim ma.y proceed with such removal and restora-
tion and charge the cost of such removal and restoration to
seid owner.
