56R-3236 r RESOLUTION NO. 3236 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY AND THAT ARTICLE IX, CHAPTER 2,OF THE ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED TO ACCOMPLISH SAID CHANGE OF ZONE. WHEREAS, the City Planning Commission of the City ot Anaheim n&s heretofore duly passed and adopted a resolution deolaring its intention to ohange the boundaries of the zone or zones hereinafter mentioned and desoribed and did fix a time and plaoe for the holding ot a public hearing thereon in the manner and as presoribed in Artiole IX, Chapter 2 of the Anaheim Munioipal Code, and did duly hold and conduot two public hearings to consider suoh proposed ohange ot zone or zones and did reoeive evidence and reports from persons . interested thereinj and WHEREAS, within a period of forty (40) days following the tinal hearing thereon, the Planning Commission did duly announo~ b1 formSlresolution its findings of faots and,deolare its opinions and reasons for recommending an amendment to said Article IX, Chapter 2 of the Anaheim Municipal Code to effect the proposed changes of the boundaries of the zone hereinafter mentioned and describedj and WHEREAS, upon receipt of the report and recommendation of the City Planning Commission, the City Council did thereupon fix the 24th day of Auril, 19,~, as the time and the Council ~bers in the City Hall of the City of Anaheim as the plaoe for a public hearing upon said proposed change of zone and did give notice thereof in the manner and as provided in said Article IX, Chapter 2 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, tne City Council did duly hold and conduct such publio hearing and did give all persons interested therein an opDortunity to be heard and did receive evidence and reports and did thereupon consider the reoommendations of the City Planning Commission; and WHEREAS, the City Council does find and determine that the property and area proposed to be chan~ed from the zone in whioh it is now situated to a different zone as hereinafter set forth, is more saitable for the zone or zones to which it is proposed to change said property and area and that the inclusion of Said property and area in such new zone or zones will increase the Value of said property and area and will not depreciate the values of property in adjoining zones. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that all of the property and area situated in the City of Anaheim, County of Orange, State of California, desoribed as follows, to wit: ~ Tract No. 2844, as recorded in Miscellaneous Maps of Orange County, Book 84, Page 23. (Said property is located at the Northwest corner of Gilbert Street and Ball Road. ) be changed from B-1, SINGLE FM~LY RESIDENTIAL ZONE, to the follow- ing zones, upon the conditions hereinafter set forth: -1- 7- .rs- - .J-~ - J I /"""' That Lots 4 to 9, inolusive, 20 to 23, inclusive, and Lots 34 and 35 in said Tract No. 2844, be changed from R-l, SINGLE FAMILY RESIDENTIAL ZONE, to R-), MULTIP.LE FAMILY RESIDENTIAL ZONE; and That Lots 1 to 3, inolusive, 11 to 18, inolusive, and 24 to )), inclusive, of said Tract No. 2844, be ohanged from R-l, SINGLE FAMILY RESIDENTIAL ZONE, to C-l, NEIGHBORHOOD-COMMERCIAL ZONE, upon the following conditions: 1. That the dwellings to be built on the lots reclassified R-), MULTIPLE FAMILY RESIDENTIAL ZONE, shall be restrioted to one-story dwellings. 2. That the owner or owners of subjeot property shall place of record appro- priate R-3 and a-I deed restrictions as required by the City of Anaheim and approved by the Oity Attorney, whioh shall apply to the property in the respeotive zones. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and direoted to prepare and submit to the City Counoil an amendment to Artiole IX, Chapter 2 of the Anaheim Munioipal Code to amend said Ana- heim Municipal Code to acoomplish the object herein found and determined to be necessary and proper.
