1962-0847RESOLUTION NO. 62R -847 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ACCEPTING A GRANT FROM SOUTHERN PACIFIC COMPANY OF THE RIGHT TO CONSTRUCT, RECONSTRUCT, MAINTAIN AND USE A STREET OR HIGHWAY UPON AND ACROSS PROPERTY OF THE GRANTOR, AND AUTHORIZING THE EXECUTION OF AN INDENTURE COVERING THE CONSTRUCTION, USE AND MAINTENANCE OF SAID STREET OR HIGHWAY. WHEREAS, the Southern Pacific Company, a corporation of the State of Delaware, has tendered to the City of Anaheim an Indenture granting to the City of Anaheim the right to construct, reconstruct, maintain and use a street or highway upon and across the following described real property, subject to the reservations, covenants and conditions therein contained: All that portion of Vineyard Lot G -3, situate in City of Anaheim, County of Orange, State of California, as shown on a map recorded in Book 4, pages 629 and 630, of Deeds, in the Office of the County Recorder of Los Angeles County, California, described as follows: COMMENCING at the intersection of the southerly line of said Vineyard Lot G -3 with a line parallel with and distant 34.75 feet Westerly, measured at right angles from the center line of Olive Street; thence North 15 31' 30" West, along said parallel line, 197.56 feet to the True Point of Beginning of the parcel of land to be described; thence continuing North 15° 31' 30" West, along said parallel line, 66.83 feet to the southerly line of Ellsworth Avenue; thence South 7L° 24' 00" West, along last said southerly line, 12.06 feet; thence South 26 50' 06" East, 54.93 feet to the beginning of a tangent curve concave Westerly having a radius of 66.00 feet; thence Southerly along the arc of said curve, through an angle of 11 18' 36 an arc distance of 13.03 feet to the True Point of Beginning, containing an area of 366 square feet, more or less. AND WHEREAS, said grantor has tendered to the City said above mentioned Indenture to be executed by the Southern Pacific Company and the City of Anaheim, which Indenture the City Council finds would be for the benefit and best interest of the City of Anaheim and should be approved. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the street or highway Indenture above mentioned tendered to the City by Southern Pacific Company, a corporation of the State of Delaware, granting to the City, but subject to the reservations, covenants and conditions therein contained, the right to construct, reconstruct. maintain and use a street or highway upon and across the real property hereinabove mentioned and described be, and the same is hereby approved and accepted. 1 BE IT FURTHER RESOLVED that the Mayor and the City Clerk be, and they are hereby., authorized to execute said Indenture for and on behalf of the City of Anaheim.
