1955-3043RESOLUTION NO. 3013 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 447. WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition from the owner of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: Commencing at a point on the Westerly line of Lot Eight (8) of "Anaheim Extension as shown on a Map of survey made by William Hamel, dated and acknowledged December 11, 1868 by A. Robinson, Trustee, and filed in the office of the County Recorder of Los Angeles County, State of California, said point being 6892 feet Northerly from the Southwest corner of said Lot Eight (8); running thence Northerly along said Westerly line of said. Lot Eight (8), 1352 feet; thence at right angles Easterly and parallel with Santa Ana Street, 211.2 feet; thence at right angles Southerly and parallel with East Street, 1351 feet; thence Westerly and parallel with Santa Ana Street to the place of be- ginning. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on Novem- ber 7, 1955, notices of which said public hearing were duly given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission, after due in- spection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. 66 Series 1955-56, denying Variance No. 447 requesting permission to erect a service station on the above described property, for the rea- sons set forth in said resolution; and WHEREAS, thereafter, within twenty (20) days from the date of the adoption of said resolution, a written appeal was filed with the City Council of the City of Anaheim requesting a review of the action taken by said Planning Commission, and said appeal was set for public hearing on the 13th day of December, 1955 at 7:00 o'clock P.M. at the City Hall, in the City of Ana- heim, and notice of such public hearing was duly given as re- quired by law and the provisions of Section 9200.17 of the Ana- heim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports and thereupon close said hearing and delay action on the matter until further investigation could be made; and WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence and reports offered at said hearing, held on December 13, 1955, the City Council does find that: -1- NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby, granted to CHARLEY KUNTZ, 302 South East Street, Anaheim, California, to erect a service station on the property hereinabove described. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owner or his heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations, and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Muni— cipal Code unless otherwise specified herein. THE FOREGOING RESOLUTION is signed and approved by me this 20th day of December, 1955. ATTEST: 1. That such a variance is necessary for the pre— servation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. 3. That the granting of such materially detrimental to injurious to the property such vicinity and zone located. 4. That the granting of such variance will not ad— versely affect the comprehensive general zoning plan.
