1955-3041RESOLUTION NO. 30L11 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING VARIANCE NO. 442. WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition from the owner and /or agent of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: Beginning at a 4" x post standing at a point 20 chains South of the quarter section corner on the North boundary of Section 22, Township 4 South, Range 10 West, S.B.B. M.; thence South parallel with the East and West boundary lines of said Section, 10 chains 302 links; thence East parallel with the South boundary of said Section, 10 chains; thence North (at 3.535 chains intersect the center line of the track of the S.P.R.R. Co.) 10 chains 302 links; thence West parallel with the said North boundary of said Section (at 5.82 chains intersect center of track of said Railroad Co.) 10 chains to the point of beginning. EXCEPTING therefrom all abutter's rights of access in and to said freeway appurtenant to the land abutting said freeway, over and across the North- easterly line of said 40 foot strip of land. (Said parcel of land lies along the Santa Ana Freeway, easterly of South Palm Street and northerly of Midway Drive, and contains 4.41 acres, more or less.) AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on October 17, 1955, notices of which said public hearing were duly given, as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code, and did continue said hearing, at the request of the applicant, to November 21, 1955; and WHEREAS, said City Planning Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearings held on October 17th and November 21, 1955, did adopt Resolution No. 81 Series 1955 -56 denying Variance No. 442 for the reasons therein stated; and WHEREAS, thereafter, within twenty (20) days from the date of the adoption of said resolution, a written appeal was filed with the City Council of the City of Anaheim protest- ing the action of the City Planning Commission denying said variance, and said appeal was set for public hearing on the 20th day of December, 1955 at 7 :00 o'clock P.M. at the City Hall in the City of Anaheim and notice of such public hearing was duly given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code; and WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence and reports offered at said hearing, the City Council does find and determine that: -1- ATTEST: 1. There is no substantial property right possessed by other property in the same vicinity and zone and denied the subject property. 2. It appears that the subject property can be adequately developed and used under the present zone. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission denying said Variance No. 442, requesting per- mission toestablish a trailer park on the above described property, be and the same is hereby sustained, and that Variance No. 442 be, and the same is hereby, denied, THE FORLGGOING RESOLUTION is sinned and approved by me this 20th day of December, 1 955.
