1955-3024A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE EXECUTION OF AN AGREEMENT BETWEEN THE CITY OF ANAHEIM AND JACK C. AND DOROTHY G. DUTTON, HUSBAND AND WIFE, OWNERS OF THE JUNGLE, RELATING TO SEWER CONNECTION. WHEREAS, Section 7501 of the Anaheim Municipal Code provides that the City Council shall, from time to time by resolution, establish the charges to be made for any and all connections with the Public Sewerage System in areas annexed to or otherwise having become a part of the City of Anaheim, from and after the 1st day of March, 1938; and WHEREAS, pursuant to the provisions of said Section 7501 of said Anaheim Municipal Code, the City Council did, on the 8th day of February, 1955, adopt Resolution No. 2632, establishing the charges to be made for any and all connections with the Public Sewerage System of the City; and WHEREAS, said Resolution 2632 does provide that the charges for residential, industrial, commercial, and other developments involving one acre or more shall be at the rate of Three Hundred Dollars ($300) per acre; and WHEREAS, Jack C. and Dorothy G. Dutton, husband and wife, are the owners of a parcel of real property located on Orangethorpe at East Street in the City of Anaheim, consisting of 5 acres; and WHEREAS, the said Jack C. and Dorothy G. Dutton, husband and wife, are conducting an eating establishment and recreation area at said address, and desires to make a connection to the sewerage system of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the said Jack C. and Dorothy G. Dutton, husband and wife, be and it is hereby, authorized to connect their place of business located on Orangethorpe at East Street in the City of Anaheim, to the Public Sewerage System in the City of Anaheim, upon the payment of $1,500.00, lawful money of the United States, which sum shall be paid to the City of Anaheim in ten (10) equal payments of $150.00 each, together with interest on all deferred payments at the rate of 6% per annum, payable monthly, commencing on the 1st day of January, 1956, and on the 1st day of each and every month thereafter until said sum, together with the interest thereon, shall have been paid in full. AND BE IT FURTHER RESOLVED that the Mayor and the City Clerk be, and they are hereby, authorized and directed to make and enter into a written agreement for and on behalf of the City of Anaheim with said Jack C. and Dorothy G. Dutton, husband and wife, upon the terms and conditions herein set forth and as more particularly set forth in the agreement dated the 29th day of November, 1955, this day submitted to the City Council, which form of agreement is hereby approved.
