1955-2974RESOLUTION NO. 2971 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING VARIANCE NO. 413. WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition from the owner of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: Lot 46 of Tract No. 14, in the City of Anaheim, as shown on a map thereof recorded in Book 9, Page 7, Miscellaneous Maps, Records of said Orange County. (Said property is located at 832 South Philadelphia Street.) AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on September 6, 1955, notices of which said public hearing were duly given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. 3l Series 1955 -56 denying Variance No. 413 for the reasons therein stated; and WHEREAS, thereafter, within twenty (20) days from the date of the adoption of said resolution, a written appeal was filed with the City Council of the City of Anaheim pro- testing the action of the City Planning Commission denying said variance, and said appeal was set for public hearing on the llth day of October, 1955, at 7 :00 otclock P.M. at the City Hall in the City of Anaheim, and notice of such public hearing was duly given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard, and did receive evidence and re- ports and thereupon close said hearing and delay action on the matter until further investigation could be made, and did declare that definite action would be taken at a meeting of the City Council to be held on October 25, 1955; and WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing held on October 11, 1955, the City Council does find and determine that: 1. There is no substantial property right possessed by other property in the same vicinity and zone and denied the sub- ject property. -2-
