1955-2958RESOLUTION NO. 2958 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING VARIANCE NO. 432. WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition from the owner of certain real property situated in the City of Anaheim, County of Oranee, State of California, described as follows: The property at the southwest corner of North Palm Street and West La. Palma Avenue, with a frontage of 190 feet on North Palm Street and a frontage of 150 feet on 'West La Palma Avenue. AND 'WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on September 6, 1955, notices of which said public hearing were duly given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code; and WHEllEAS, said City Planning Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. 38 Series 1955-56, recommending that Variance No. 432 be granted permitting the erection of a service station on the above described property; and WHEREAS, thereafter, within twenty (20) days from the date of the adoption of said resolution, a written a:Teal was filed with the City Council of the City of Anaheim opoos- ing the granting of said variance, and said appeal was set for public hearing on the ilth day of October, 1955 at 7:00 otclock P.L., at the City Hall in the City of Anaheim, and notice of such public hearirr was duly given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code; and WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence and re orts offered at said hearing, the City Council does find and determine that: 1. There is no substantial property right possessed by other property in the same vicinity and zone and denied the subject property. 2. It apeears that the subject property can be adequately developed and used under the present zone. NOW, THERORE, El IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission recotLmendin: the granting of Variance No. 432, requesting permission to erect a service station on the above described property, be and the same is hereby disapproved, and said variance is hercby denied in accordance with Section 2310.6 of the Anaheim Municipal Code. 1 THE TOREAING RESOLUTION is approved and signed by me this llth day of October, 1955. 6mr CITY CLERK 07 THE CITY OF ANAHEIM.
