1955-2930RESOLUTION NO. 2930 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY AND THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED TO ACCOMPLISH SAID CHANGE OF ZONE. WHEREAS, the City Planning Commission of the City of Anaheim has heretofore duly passed and adopted a resolu- tion recommending that a change in the boundaries of the zone or zones hereinafter mentioned and described be disapproved, after having fixed a time and place for the holding of a public hearing thereon in the manner and as prescribed in Article IX, Chapter 2 of the Anaheim Municipal Code, and after having duly held and conducted such public hearing to consider said proposed change of zone or zones, and after having received evidence and reports from persons interested therein; and WHEREAS, within a period of forty (0) days follow- ing the hearing thereon, the Planning Commission did duly announce by formal resolution its findings of facts and de- clare its opinions and reasons for recommending that said proposed change in the boundaries of the zone or zones here- inafter mentioned and described be disapproved; and WHEREAS, upon receipt of the report and recommenda- tion of the City Planning Commission, the City Council did thereupon fix the 13th day of September, 1955 as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed change of zone or zones, and did give notice thereof in the manner and as provided in said Article IX, Chapter 2 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports, and did thereupon consider the recommendations of the City Planning Commission; and WHEREAS, the City Council does find and determine that the property and area proposed to be changed from the zone in which it is now situated to different zones, as hereinafter set forth, is more suitable for the zones to which it is proposed to change said property and area and that the inclusion of said property and area in such new zones will increase the value of said property and area and will not depreciate the values of property in adjoining zones. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that all of the property and area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: Beginning at a point of intersection of the center lines of Broadway and Landing Road, now known as Garden Grove Road, as shown on a map of J. W. Clark Addition to Anaheim, recorded in Book 31, Page 100 of Miscellaneous Records of Los Angeles County, California, -1- said point being also the northwest corner of the northwest quarter of the southwest quarter of the northwest quarter of Section 16, Town- ship 4 South, Range 10 West, San Bernardino Base and Meridian; thence south along said center line of Garden Grove Road, 660.10 feet to the southwest corner of the northwest quarter of the southwest quarter of the north- west quarter of said Section 16; thence east along the south line of said northwest quarter, of the southwest quarter of the northwest quarter of Section 16, 350.42 feet to a point; thence north 661.30 feet to a point in the center line of Broadway, distant 349.70 feet from the point of beginning; thence west to the point of beginning. Said property is located at the southeast corner of Broadway and Euclid Avenue, be changed from the present classification of R -A, RESIDENTIAL AGRICULTURAL ZONE, to the following zones, upon the conditions hereinafter set forth: That all of subject area and property be re- classified to C -1, NEIGHBORHOOD COMMERCIAL ZONE, with the exception of the corner thereof with a frontage of 150 feet on Broadway and 150 feet on Euclid Avenue, and t hat this portion be changed to C -2, GENERAL CO ,11ERCIAL ZONE, upon the following conditions: 1. That all plans and specifications for buildings to be erected on the property shall be subject to approval of an Architectural Committee con- sisting of the following: (a) One representative of the owner, his heirs or assigns. (b) One representative of the City appointed by the City Council. (c) An architect or designer designated by the owner or purchaser. This committee shall review the plans and speci- fications for structural requirements, archi- tectural design, building locations, parking facilities and other matters included within the deed restrictions, and one set of plans shall be signed by each of the Architectural Committee and filed with the Building Inspector of the City of Anaheim. 2. That all buildings with 9,000 square feet or over under one roof shall be masonry or similar fire resistant materials. All other buildings shall comply with Fire Zone No. 2 requirements. 3. That the architectural design must be such that the buildings will retain a definite character in keeping with each other. 4. That no building shall be used for residential purposes unless rezoned. 5. That the off- street parking requirements specified by the Anaheim Municipal Code for C -1 and C -2 ZONES shall be complied with. 6. That no wall or fence shall enclose any portion of the customer parking area to the exclusion of ad- jacent parking areas. 7. That these restrictions shall expire 25 years from date hereof. 8. That all requirements of the City of Anaheim relating to sidewalks, curbs, streets, grading, paving, and other engineering requirements shall be complied with as recommended by the City Engineer. BE IT URTHER RESOLVED that the City Attorney be, and he is hereby, authorized and directed to prepare and submit to the City Council an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to amend said Anaheim Municipal Code to accomplish the object herein found and determined to be necessary and proper.
