1955-2928RESOLUTION NO. 2928 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING VARIANCE NO. 382. WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition from the owner of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: Beginning at a point 539.70 feet west of the center- line of Gilbert Street along the northerly right -of -way line of Lincoln Avenue which is the true point of beginning; thence north at right angles to Lincoln Avenue 183 feet; thence west 69.37 feet parallel to Lincoln Avenue; thence south 183 feet at right angles to Lincoln Avenue; thence east 69.37 feet along the northerly right -of -way line of Lincoln Avenue; to the true point of beginning. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on July 5, 1955 and continued on August 1, 1955, notices of which said public hearing were duly given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission, after due in- spection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. 14 Series 1955-56, granting said Variance No. 382 upon the conditions stated in said resolution; and WHEREAS, thereafter, within twenty (20) days from the date of the adoption of said resolution, a written appeal was filed with the City Council of the City of Anaheim opposing the granting of said variance, and said appeal was set for public hearing on the 13th day of September, 1955 at 7:00 o'clock P.M., at the City Hall in the City of Anaheii, and notice of such public hearing was duly given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code; and WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence and reports offered at said hearing, the City Council does find and determine that: 1. There is no substantial property right possessed by other property in the same vicinity and zone and denied the subject property. 2. It appears that the subject property can be adequately developed and used under the present zone. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Com- mission granting Variance No. 382, requesting permission to erect a retail store building for the sale of sporting goods, assembly of small boat units, marine supplies and outboard motors: be and the same is hereby disapproved, and said variance is hereby denied. -1- THE FOREGOING RESOLUTION is signed and approved by me this 13th day of September 1955 ATTEST: t.
