1955-2882RESOLUTION NO. 2882 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 378. WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition from the owner and /or agent of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: All of that real property located at 536 -700 West Romneya Drive, in the City of Anaheim, as shown on a map recorded in Book 4, Page 7, Miscellaneous Maps, Records of Orange County, California, and more particularly described as follows: PARCEL 1: All of the North 280.6 feet of the West 206 feet of Lot 12, Miles Rancho, measured to the center of the street adjoining. PARCEL 2: All of the South 100 feet of the North 230.6 feet of the West 556 feet, except that portion described as the West 206 feet, Lot 12, Miles Rancho, measured to the center of the street adjoining. SUBJECT TO an easement of 20 feet along the North boundary for street purposes, and a dedication to the City of Anaheim of an addi- tional 10 feet along the East 350 feet of the West 556 feet along the north boundary. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on June 27, 1955, notices of which said public hearing were duly given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. 190 Series 1954 -55, denying Variance No. 378, requesting permission to utilize the westerly portion of the land lying on West Romneya Drive and also the 350 feet south of the present trailer site for additional trailer sites, for the reasons set forth in said resolution; and WHEREAS, thereafter, within twenty (20) days from the date of the adoption of said resolution, a written appeal was filed with the City Council of the City of Anaheim re- questing a review of the action taken by said Planning Com- mission, and said appeal was set for public hearing on August 9, 1955 at 7:00 o'clock P.M. at the City Hall, in the City of Anaheim, and notice of such public hearing was duly given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code; and WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence and reports offered at said hearing, the City Council does find that: -1- 1. There are exceptional or extraordinary circum- stances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 2. That such a variance is necessary for the pre- servation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 4. That the granting of such variance will not ad- versely affect the comprehensive general zoning plan. NOW, THE FOB, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby, granted to MILTON M. SELL, 1067 North Palm, Anaheim, California, to utilize the hereinabove de- scribed property for additional trailer spaces, upon the fol- lowing conditions: 1. That a solid 6 -foot block wall be built across the entire south line of the trailer property. 2. That no trailer be parked within a minimum of eighteen (16) feet of the south line of the trailer park property. 3. That adequate off street parking facilities be provided for vehicles of all of the trailer residents. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owner or his heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations, and the conditions herein. Said variance is granted for the term prescribed by the Ana- heim Municipal Code unless otherwise specified herein. THE FOREGOING RESOLUTION is signed and approved by me this 9th day of August, 1955.
