A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AUTHORIZING THE MAYOR AND THE
CITY CLERK TO ENTER INTO AN AGREEMENT WITH
THE STATE OF CALIFORNIA, DEPARTMENT OF PUBLIC
WORKS, FOR THE CONSTRUCTION BY THE STATE,
PRIOR TO THE SCHEDULED CONSTRUCTION THEREOF,
OF THE "OFF RAMP" IN THE SOUTHEAST QUADRANT
OF THE INTERCHANGE OF THE SANTA ANA FREEWAY
AND HARBOR BOULEVARD; AND AUTHORIZING THE
CITY AUDITOR TO DEPOSIT FUNDS WITH THE STATE
SUFFICIENT TO COMPENSATE THE STATE'S CON-
TRACTOR FOR ADDITIONAL COSTS INCURRED THEREBY.
WHEREAS, the City of Anaheim proposes to improve Harbor
Boulevard adjacent to and south of the interchange now being con-
structed under State Contract 55 7VC 29 by J. A. Thompson and
Sons, Contractor; and
WHEREAS, the State's plans for said interchange calls
for the construction of an "off ramp" in the southeast quadrant
between the Santa Ana Freeway and Harbor Boulevard; and
WHEREAS, the City of Anaheim has requested the State to
arrange for the State Contractor to proceed with construction of
said "off ramp" prior to his schedule of construction operations
so that it will be available for use when improvement of Harbor
Boulevard is completed; and
WHEREAS, the State Contractor is willing to construct
said "off ramp" prior to his schedule, provided he is compensated
for additional costs incurred by moving in and out, which addi-
tional costs are not to exceed Two Thousand Dollars ($2,000); and
WHEREAS, the City Council does find and determine that
the construction of said "off ramp" ahead of schedule is neces-
sary and desirable and for the best interests of the City, and
that the estimated cost thereof is reasonable and not dispro-
portionate to the value of said project.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ANAHEIM that the agreement this day submitted to the
City Council of the City of Anaheim by the State of California,
Department of Public Works, whereby the State agrees to have the
State Contractor proceed with construction of the "off ramp" in
the southeast quadrant between the Santa Ana Freeway and Harbor
Boulevard, prior to the State Contractor's schedule of construct-
ion operation, upon the terms and conditions set forth in said
agreement, be and the same is hereby approved; and that the Mayor
and the City Clerk be, and they are hereby, authorized and dir-
ected to execute said agreement for and on behalf of the City of
Anaheim.
AN BE IT FURTHER RESOLVED that upon the execution of
this agreement by the Mayor and the City Clerk, the City Auditor
of the City of Anaheim be, and she is hereby, authorized and
directed to deposit the sum of Two Thousand Dollars ($2,000)
with the State, said sum being the maximum amount necessary to
compensate the State's Contractor for additional costs to be
incurred by him in the performance of said work and the amount
required to be deposited by the terms of said agreement.
THE FOREGOING RESOLUTION is signed and approved by me
this 12th day of July, 1955.
