1955-2834WHEREAS, public convenience and necessity require
the construction and completion of a public improvement
partly within the unincorporated area of the County of Orange
and partly within the limits of the City of Anaheim, to wit:
the widening, excavation, grading, paving and installation of
curb returns and appurtenant work upon and along West Street
from Katella Avenue to Ball Road; and
WHEREAS, it is deemed to be to the mutual advantage
of the City of Anaheim and the County of Orange and in the
public interest that said improvement be made and constructed
jointly in accordance with the terms and conditions of an
agreement dated June 28, 1955 and this day submitted to the
City Council.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that said public improvement herein
above mentioned and described be jointly made and constructed
by the County of Orange and the City of Anaheim, in accord-
ance with the terms, conditions and provisions of the agree-
ment of June 28, 1955, which said agreement is hereby approved,
and the Mayor and the City Clerk are hereby authorized and
directed to execute said agreement for and on behalf of the
City of Anaheim; and
BE IT FURTHER RESOLVED that the City of Anaheim shall,
at its cost and expense, acquire all rights of way necessary
for that portion of the project lying within the limits of the
City, and that the County shall acquire, at its cost and ex-
pense, all rights of way necessary for that portion of the
project lying within the unincorporated area of the County; and
that the cost of such public improvement situated within the
incorporated area of the City shall be paid by the City, and
that the portion of said improvement situated within the un-
incorporated area of the County shall be paid for by the
County; and
BE IT FURThER RESOLVED that the City of Anaheim shall
act as the contracting agent for the County of Orange and the
City of Anaheim, to do and perform all acts and things neces-
sary or required for the construction and completion of said
improvement hereinabove mentioned, and to execute and deliver
all documents necessary and required in the construction and
completion of said project.
THE FOREGOING RESOLUTION is signed and approved by
