1955-2807WHEREAS, heretofore, to wit: On or about the 30th day of July, 1940, an agreement was made and entered into by and between the City of Anaheim and U. S. Industrial Chemicals, Inc., a Delaware corporation, for the leasing by the City of Anaheim from said U. S. Industrial Chemicals, Inc. of certain real property owned by said U. S. Industrial Chemicals;'Inc., and more particularly described in said agreement and providing for the payment of rental by the City of Anaheim and for the dis- charge of sewage and industrial waste by said U. S. Industrial Chemicals, Inc., into the sewage disposal system of the City of Anaheim; and WHEREAS, said lease and agreement was thereafter extended to the 30th day of June, 1955; and WHEREAS, said U. S. Industrial Chemicals, Inc. is now a division of National Distillers Products Corporation, a Virginia corporation, and said National Distillers Products Corporation has requested an extension of said lease for a further term of five (5) years; and WHEREAS, an agreement and lease, dated June 15, 1955, has been prepared by the City Attorney and submitted to the City Council for its approval and the City Council does find and determine that it would be to the advantage of the City of Anaheim to enter into an agreement and lease with the National Distillers Products Corporation extending the term of the old lease for a term of five (5) years from July 1, 1955, to June 30, 1960, upon the terms and conditions set forth in said agreement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL that the proposed agreement, dated June 15, 1955, to be made and entered into by and between the City of Anaheim, Lessee, and National Distillers Products Corporation, as Lessor, for the leasing for the term of five (5) years of the land and premises therein described and upon the terms and conditions therein set forth and providing for the discharge of sewage and industrial waste into the sewage disposal system of the City of Anaheim, and providing for the payment by said Lessor for the treatment of said sewage when the biochemical oxygen demand exceeds seven hundred fifty (750) parts per million, and fixing the amounts of such charges be and the same is hereby approved, and that the Mayor and the City Clerk be and they are hereby authorized and directed to execute said agreement for and on behalf of the City of Anaheim. this Attest: City Clerk RESOLUTION NO. 2807 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE EXECUTION OF A LEASE AND AGREEMENT WITH NATIONAL DISTILLERS PRODUCTS CORPORATION, U. S. INDUSTRIAL CHEMI- CAL COMPANY DIVISION, RELATING TO THE LEASING OF CERTAIN REAL PROPERTY AND THE TREATMENT OF SEWAGE AND INDUSTRIAL WASTE.
