1955-2757RESOLUTION NO. 2757 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE PURCHASE AND ACQUISITION OF CERTAIN RJSAL PROPERTY FOR PUBLIC PURPOSES AND AUTHORIZING THE PAYMENT OF THE PURCHASE PRICE FROM THE GENERAIL FUND. WHEREAS, Joseph Garcia and Ruth Garcia, husband and wife, are the owners of the hereinafter described real property situated in the City of Anaheim, County of Orange, State of California, and WHEREAS, said owners have offered to sell said prop- erty to the City of Anaheim for the sum of Eight Thousand Dollars (48,000.00) cash, lawful money of the United States, and WHEREAS, the City Council does find and determine that public convenience and necessity require the purchase and acquisition of said parcel of real property, that said property is needed for public use, and that the price which the owners thereof are willing to accept is reasonable and not out of pro- portion to the reasonable value of said property. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the offer of Joseph Garcia and Ruth Garcia to sell said property situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: Lot 25 of Vineyard Lot "E5" of the Langenberger Tract, in the City of Anaheim, County of Orange, State of California, as per map thereof recorded in Book 1, Pages 551 and 5,52 of Miscellaneous Records in the office of the County Recorder of Los Angeles County, California. EXCEPTING THEREFROM the South 75 feet. Subject to all taxes for the fiscal year 1955 —'56, a lien not yet payable, and subject to covenants, con- ditions, restrictions and public utility easements of record. for the sum of Eight Thousand Dollars (48,000.00) in cash, lawful money of the United States, be and the same is hereby accepted, subject to the terms and conditions hereinafter stated. AND BE IT FURTHER RESOLVED that the City Treasurer be, and he is hereby authorized to deposit in escrow at Title Insurance Trust Company, Santa Ana, California, ttie sum of E igE r hosband Dollars, 000.00 and trat cr en any reputable title company in Orange County, California, can issue its policy of title insurance showing said property to be vested in the City of Anaheim, free and clear of all encum- brances except all general and special taxes for the fiscal year 1955 56, and subject to covenants, conditions, restrictions, -1- reservations, rights, rights of way and easements of record, if any, that the deed tendered by said owners to the City of Anaheim shall be recorded and such policy of title insurance shall be issued, and the purchase price of Eight Thousand Dollars (,8,000.00) in cash shall be paid to the owners of said property. AND BE IT FURTHER RESOLVED that the seller shall pay the usual and customary sellers' charges for furnishing a policy of title insurance necessary to show title vested in the City of Anaheim, as herein provided, and that the City of Anaheim shall pay the usual buyer's charges in the purchase of said property.
