1955-2748RESOLUTION NO. 2748 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING THE ACTION OF THE CITY PLANNING COMEISSION DENYING SPECIAL USE PERMIT TO MANL7Y-KURNS CORPORATION FORJA DRIVE-IN THEATRE. WHEREAS, on or about the 18th day of February, 1955, the City Planning Commission of the City of Anaheim did receive an application from Manley-Kuhns Corporation, 512 N. La Brea Avenue, Los Angeles 36, California, for a special use permit to construct and operate a drive-in theatre on the following de- scribed property: The area bounded by Cerritos Avenue, Walnut Street, the Edison Co. right-of-way and Ninth Street, EXCEPT that portion included in Tract No. 1647, and consisting of 20 acres, more orjess. AND WHEREAS, said Planning Commission did thereupon give legal notice that it would hold a public hearing in the City Council Chambers of the City Hall in the City of Anaheim on Monday, March 7, 1955, at the hour of 2:00 o'clock P.M. to review said application for said proposed use, and notifying all interested persons to attend said hearing and express opinions for or against the granting of said special use permit, and did cause said notice to be published on FebruaTy 28, 1955, and did cause notice thereof to be given by mailing a postal card notice not less than ten (10) days prior to the date of such hearing to the owners of property within a radius of 300 feet of the exterior boundaries of the property for which such special use permit was requested, using for that purpose the last known name and address of such owners as shown upon the assessment roll of Orange County, which said postal card did contain information as to the time and place where said hear- ing would be held and the purpose of said hearing, and notify- ing all persons interested therein to appear and express opinions either for or against the granting of said special use permit; and WHEREAS, on said 7th day of March, 1955, the City Planning Commission did meet in regular session and did ad- journ said meeting until the 14th day of March, 1955, at which time said Planning Commission did hold and conduct a public hearing upon said application for said special use permit and did receive evidence and reports from all persons who appeared at said meeting and offered evidence or expressed opinions; and said Planning Commission did thereupon adopt its Resolution No. 124 Series 1954-55 recommending to the City Council of the City of Anaheim that a special use permit be denied for a drive-in theatre at said location; and WHEREAS, within twenty (20) days from and after the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the Plan- ning Commission in denying said special use permit, and did set a public hearing thereon to be held on the 5th day of A:pril, 1955 at 7:00 o'clock P.E. in the City Hall in the City of Anaheim, and did give notice thereof as provided by law; and -1- STATE OF CALIFORNIA COUNTY OF ORANGE ss. None. None. AND I FURTHER CERTIFY that the Mayor of the City of Anaheim approved and signed said resolution on the 10th day of May, 1955. CITY CLERK OF THE CITY OF ANAHEIM WHEREAS, at the time and Place fixed for said public hearing, the City Council did duly hold and conduct such hear- ing and did give all persons interested therein an opportunity to be heard, and did declare that the matter of said special use permit would be given further consideration and a decision rendered at a later date, and did thereupon close said hearing; and WHEREAS, the City Council does find, after due in- vestigation and consideration of all evidence and reports submitted, that: 1. There is no substantial property right Possessed by other property in the same vicinity and zone and denied the subject property. ATTPST: 2. It appears that the subject property can be adequately developed and used under the present zone. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Com- mission denying a Special Use Permit to MANLEY-KUHNS CORPORA- TION, 512 N. La Brea Avenue, Los Angeles 36, California, to construct and operate a Drive-In Theatre on the following described property, consisting of 20 acres, more or less: The area bounded by Cerritos Avenue, Walnut Street, the Edison Co. right-of-way and Ninth Street, EXCEPT that portion included in Tract No. 1647. be, and the same is hereby, approved, and that said Special Use Permit be, and the same is hereby, denied.
