1955-2743RESOLUTION NO. 2743 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING AND AUTHORIZING THE EXECUTION OF AN AGREEMENT BETWEEN THE CITY OF ANAHEIM AND S. H. RUBBISH HAULING RELATING TO THE COLLECT- ION AND DISPOSAL OF RUBBISH AND TRASH. WHEREAS, A. W. Samoff, Karo Marikian and J. P. Samarin, copartners, doing business under the firm name and style of S. H. Rubbish Hauling, have submitted a proposal to the City for the collection and disposal of rubbish and trash (excepting building materials and garbage) from all of the outlying resi- dential areas of the City, being the territory outside of that portion of the City bounded on the north by La Palma Avenue, on the south by Ball Road, on the east by Placentia Avenue, and on the west by Loara Street and the Santa Ana Freeway, offering to take over and collect all combustible and non combustible rub- bish and trash from the area of the City bounded by said streets and highway within six months from date of April 30, 1955, or as soon as proper schedules and transfers of the personnel of the City to other departments can be arranged; and WHEREAS, said A. W. Samoff, Karo Marikian and J. P. Samarin, copartners, doing business under the firm name and style of S. H. Rubbish Hauling, have offered to collect and dispose of said combustible and non combustible rubbish and trash once a week from each occupied home within the above described area for the sum of 45¢ per month per home, such col- lection and disposal of said rubbish and trash to be by truck of a type acceptable to the City; and WHEREAS, the City Council finds that the acceptance of said offer and proposal for the collection and disposal of rub- bish and trash would be for the benefit and best interest of the City, and that such offer should be accepted. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the proposal submitted by said A. W. Samoff, Karo Marikian and J. P. Samarin, copertners, doing business under the firm name and style of S. H. Rubbish Haul- ing, be accepted and that they be employed as independent con- tractors for a period of three years, from the 1st day of June, 1955 to the 31st day of May, 1958, to collect, pick up, remove and dispose of all combustible and non combustible rubbish and trash (excepting building materials and garbage) upon and along the streets and alleys and from the homes within all of that outlying territory of the City of Anaheim bounded on the north by La Palma Avenue, on the south by Bali Road, on the east by Placentia Avenue and on the west by Loara Street and the Santa Ana Freeway, and to collect and dispose of the rubbish and trash from the territory within the above described boundaries within six months from date hereof, or as soon as proper schedules can be arranged. BE IT FURTHER RESOLVED that said collection, removal and disposal of said rubbish and trash shall be done once a week from each of the homes situated within said area, and the streets and alleys within said area, and that it shall be by motor truck acceptable to the City of Anaheim; that the time of collection and pickup shall be between the hours of 6:00 A.M. and 6:00 P.M.; that all rubbish and trash shall be transported to the County Dump or shall be disposed of in such other places or in such other manner as shall be directed by the City and not in viola- tion of any State law or County or City ordinance, rule or regu- lation; and that the collection and disposal of said rubbish and trash shall be done promptly on schedule in a manner satisfactory to the City of Anaheim. -1- BE IT FURTHER RESOLVED that said contractors be, and they are hereby, required to furnish the City a Faithful Performance Bond in the sum of r ;20,000 to guarantee the faithful performance of the contract to be entered into by and between said contractors and the City of Anaheim. AND BE IT FURTHER RESOLVED that said contractors shall be, and they are hereby, required to carry and main- tain compensation insurance satisfactory to the City cover- ing all of their employees used in the collection and dis- posal of said rubbish and trash, and public liability insurance with a minimum limit of 050,000 for one person and 0100,000 for more than one person, for injuries arising from any one accident, and property damage insurance with a mini- mum limit of y ;5,000 and a maximum limit of 25,000 upon each vehicle operated by them. BE IT FURTHER RESOLVED that said contractors shall recieve as full compensation for such contract and work the sum of 4.V per month for one pickup per week, per residence as shown by the records in the City Public Service Department. BE IT FURTHER RESOLVED that the City Council does hereby reserve the right to extend the contract from month to month for a reasonable period of time upon the same terms and conditions as herein set forth, during negotiations for a renewal of said contract; but subject, nevertheless, to termination by the City of Anaheim upon ten days' written notice. BE IT FURTHER RESOLVED that the Mayor and the City Clerk be, and they are hereby authorized and empowered to enter into a contract for and on behalf of the City of Anaheim with said contractors for the doing of said work upon the terms and conditions herein set forth.
