1955-2735REESOLUTION NO. 2735 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY AND THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED TO ACCOMPLISH SAID CHANGE OF ZONE. WHEREAS, the City Planning Commission of the City of Anaheim has heretofore duly passed and adopted a resolu- tion recommending denial of a change in the boundaries of the zone or zones hereinafter mentioned and described, after having fixed a time and place for the holding of a public hearing thereon in the manner and as prescribed in Article IX, Chapter 2 of the Anaheim Municipal Code, and after hav- ing duly held and conducted such public hearing to consider said proposed change of zone or zones, and after having re- ceived evidence and reports from persons interested therein; and WHEREAS, within a period of forty (40) days follow- ing the hearing thereon, the Planning Commission did duly announce by formal resolution its findings of facts and de- clare its opinions and reasons for recommending a denial of said proposed change in the boundaries of the zone or zones hereinafter mentioned and described; and WHEREAS, u,on receipt of the report and recommenda- tion of the City Planning Commission, the City Council did thereupon fix the 5th day of April, 1955 as the time and the Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed change of zone or zones, and did give notice thereof in the manner and as provided in said Article IX, Chapter 2 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such public hearing and did give all persons interested there- in an opportunity to be heard and did receive evidence and reports and did thereupon consider the recommendations of the City Planning Commission, and did close said hearing and declare that a decision would be rendered on said proposed change of zone or zones at a later date; and WHEREAS, the City Council does find and determine that the property and area proposed to be changed from the zone in which it is now situated to a different zone, as hereinafter set forth, is more suitable for the zone to which it is proposed to change said property and area, and that the inclusion of said property and area in such new zone will in- crease the value of said property and area and will not de- preciate the values of the property in adjoining zones. NOW, THER,FORE, BE IT RESOLVED by the City Council of the City of Anaheim that all of the property and area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: The lots in Tract No. 1647 lying along Ninth Street, for a depth of three lots, and along Cerritos Avenue for a depth of one lot. -1- be changed from the present classification of R -A, RESIDENTIAL AGRICULTURAL ZONE, to R -3, MULTIPLE FAMILY RESIDENTIAL ZONE, upon the following conditions: 1. That said property shall be used for multiple housing, and that the plans and specifications shall be submitted to the City Council and an Architectural Committee for final approval; and that said multiple housing shall be of the general character and type of the artist's rendering and plans previously submitted to the City Council. 2. That all plans and specifications for build- ings to be erected on the property shall be subject to approval of an Architectural Com- mittee consisting of the following: (a) One representative of the owners, their heirs or assigns. (b) One representative of the City appointed by the City Council. (c) An architect or designer designated by the owners and the City. This committee shall review the plans and specifications for structural requirements, architectural design, building locations, parking facilities, and other matters re- quired in an R -3 Zone, or any deed restric- tions affecting said property, and one set of plans shall be signed by each of the Architectural Committee and filed with the Building Inspector of the City of Anaheim. 3. That the architectural design must be such that the buildings will retain a definite character in keeping with each other. 1 That all requirements of the City of Anaheim relating to sidewalks, curbs, streets, street grading and paving, and installation of sewers and water mains, and other tract im- provements and engineering requirements shall be complied with. BE IT FUTH ER RESOLVED that the City Attorney be, and he is hereby, authorized and directed to prepare and submit to the City Council an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to amend said Anaheim Municipal Code to accomplish the object herein found and determined to be neces- sary and proper. -2- THE FOREGOING RESOLUTION is signed and approved by me this 26th day of April, 1955.
