1955-2730RESOLUTION NO. 2730 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING A SPECIAL USE PERMIT FOR THE CONSTRUCTION AND MAINTENANCE OF A HOSPITAL AT BROOKHURST AND LA PALI'MIA AVENUES IN THE CITY OF ANAHEIM. WHEREAS, on or about the 4th day of April, 1955, the City Planning Commission of the City of Anaheim did re- ceive an application from Valley Investment Co., c/o Arthur B. Weber, 6338 Wilshire Boulevard, Los Angeles 48, California, by Medaris -Smith Real Estate, authorized agent, for a special use permit to erect and operate a hospital on the following described property: That portion of the Southeast Quarter of the Southeast Quarter of Section 6, Township 4 South, Range 10 West, S.B.B. M. of the Rancho Los Coyotes, County of Orange, State of California, described as follows: Begin- ning at a point in the East line of said Section 6, 300 feet North from the Southeast corner thereof; thence West and parallel to the South line of said Section 6, 686 feet; thence North 314 feet; thence East 686 feet to the East line of said Section 6; thence South along said East line 314 feet to the point of beginning; AND WHEREAS, said Planning Commission did there- upon give legal notice that it would hold a public hearing in the Council Chambers of the City Hall in the City of Anaheim on Monday, the 18th day of April, 1955, at the hour of 2 :00 o P.M. to review said application for said proposed use, and notifying all interested persons to attend said hearing and express opinions for or against the grant- ing of said special use permit, and did cause said notice to be rpublished on April 11, 1955, and did cause notice thereof to be given by mailing a postal card notice not less than ten (10) days prior to the date of such hearing to the owners of property within a radius of 300 feet of the ex- terior boundaries of the property for which such special use permit was requested, using' for that purpose the last known name and address of such owners as shown upon the assessment roll of Orange County, which said postal card did contain information as to the time and place where said hearing would be held and the purpose of said hearing, and notifying all persons interested therein to appear and express opinions either for or against the granting of said special use permit; and WHEREAS, on said 18th day of April, 1955, the City Planning Commission did hold and conduct a public hearing upon said application for said special use permit and did receive evidence and reports from all persons who appeared at said meeting and offered evidence or expressed opinions; and said Planning Commission did thereupon adopt its Resolution No. 138 Series 1954 -55, recommending to the City Council of the City of Anaheim that a special use permit be granted subject to: 1. The deeding of ten feet along North Brookhurst Avenue to the City of Anaheim for street widen- ing. -1- AND WHEREAS, the City Council finds, after careful consideration of the recommendations of the City Planning Commission, that said special use permit should be granted upon the terms and conditions hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a Special Use Permit be, and the same is hereby, granted to VALLEY INVESTLENT CO., c/o Arthur B. Weber, 6338 Wilshire Boulevard, Los Angeles 48, California for the construction and maintenance of a hospital on the property described as: That portion of the Southeast Quarter of the Southeast Quarter of Section 6, Township 4 South, Range 10 West, S.B.B. M. of the Rancho Los Coyotes, County of Orange, State of California, described as follows: Begin- ning at a point in the East line of said Section 6, 300 feet North from the Southeast corner thereof; thence West and parallel to the South line of said Section 6, 686 feet; thence North 314 feet; thence East 686 feet to the East line of said Section 6; thence South along said East line 314 feet to the point of beginning, upon the following express conditions: 3. That an artistts rendering or perspective of all buildings shall be submitted, showing eleva- tions; -2- 2. The filing of precise plans for the hospital and other buildings together with the required off-street parking. 3. Engineering requirements, such as the instal- lation of curbs, sidewalks, and other improve- ments. 1. That a plot plan showing the number and size of rooms and the proposed uses of rooms be sub- mitted to the City Council of the City of Anaheim for its approval; 2. That a statement of the kind and character of equipment and facilities to be installed and used in said hospital and a statement of the method of operation of said hospital be submitted to the City Council, all of which shall meet the standards of Class A hospitals; 4. That a faithful performance bond in the amount of 450,000, in favor of the City of Anaheim, be executed and delivered to the City of Anaheim with- in thirty (30) days from date hereof, conditioned for the commencement of the construction of said hospital within six (6) months from date hereof, in accordance with plans and specifications ap- proved by the City Council; 5. The execution of a 100% faithful performance bond and a 100% labor and material bond conditioned for the faithful performance and completion of the contract for construction of said hospital building THE FOREGOING RESOLUTION is signed and approved by me this 21st day of April, 1955. A`I'EST and the equipment thereof within a period of eight (8) months from the time of commencement of con- struction thereof, which said bondsshall be executed by the principal, and a corporate surety satisfactory to the City of Anaheim, and conditioned for the pay- ment of the principal sum or so much thereof as may be necessary, to the City of Anaheim for the comple- tion and construction or equipment of said hospital, and the payment of all labor and :raterial charges or liens thereon; 6. That all buildings be set back a minimum of 65 feet from the center of the street on Brookhurst Avenue. 7. That a statement be furnished to the City Council explaining participation of local doctors; 8. That the approximate cost of said hospital shall be X500,000; 9. That said use permit and all documents required to be submitted as herein provided shall be submitted to the Administrative Officer and the City Attorney for their recommendation before said use permit shall be- come effective; 10. That all of said documents, information and state- ments, and the performance bond for 50,000, shall be furnished to the City Council on or before thirty (30) days from date hereof; 11. That in the event of the failure to comply with any of the foregoing requirements to the satisfac- tion of the City Council within said thirty (30) days, or such further time as the Council may grant, then said special use permit shall become null and void. jam£_ f ler CITY CCj RK OF THE CITY OF ANA °'EIM.
