1955-2717RESOLUTION NO. 2717 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE PURCHASE AND AC4UISITION OF CERTAIN REAL PROPERTY FOR PUBLIC PURPOSES; AUTHORIZING THE PAYMENT THEREFOR TO BE MADE PARTLY IN CASH AND PARTLY IN PROPERTY; AND AUTHORIZING THE EXECUTION OF A CONVEYANCE OF SAID PROPERTY. WHEREAS, Richard L. Martin and Irene V. Martin are the owners of the hereinafter described real property situated in the County of Orange, State of California; and WHEREAS, said owners have offered to sell said property to the City of Anaheim for the sum of 2,760.00, cash, and a deed to that certain real property described in Escrow No. A -3605 with the All Service Corporation, 211 East Center Street, Anaheim, California, having a representative value of $4 and making a total consideration of G7,680.00; and WHEREAS, the City Council does find and determine that public convenience and necessity require the acquisition of said parcel of real property; that said property is needed for public use; and that the price which the owners thereof are willing to accept is reasonable and not out of proportion to the reasonable value of said property. NOW, THEREFORLE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANAHEIM that the offer of Richard L. Martin and Irene V. Martin, husband and wife, to sell said property situated in the County of Orange, State of California, de- scribed as follows, to wit: Lot 4 as shown on a map of a part of the West half of Lot 9 of Anaheim Extension, as per map thereof recorded in Book 1, Page 53, Records of Survey, in the Office of the County Recorder of Orange County, California, EXCEPTING THEREFROM the Northerly 300 feet, measured to the center line of Center Street, ALSO EXCEPTING THEREFROM the Southerly 170 feet, for the sum of 2,760.00 in cash, and a deed to that certain real property described in Escrow No. A -3605 with the All Service Corporation, 211 East Center Street, Anaheim, Cali- fornia, having a representative value of 44_,920.00, making a total consideration of $7,680.00, be and the same is hereby accepted, subject to the terms and conditions hereinafter stated. BE IT FURTHER RESOLVED that the City Treasurer be, and he is hereby, authorized to deposit in escrow with the All Service Corporation, 211 East Center Street, Anaheim, California, the sum of c2,760.00, cash; and that the Mayor and the City Clerk be, and they are hereby, authorized to execute a good and sufficient deed conveying to said Richard L. Martin and Irene V. Martin, husband and wife, that certain real property described in Escrow No. A -3605 with All Service Corporation, 211 East Center Street, Anaheim, California, as follows: -1- The South 170 feet of the West half of the East half of the North half of Lot 9, Anaheim Extension, as shown on a map thereof made by William Hamel in 1868, and filed in Book 3, pages 162 -164, inclusive, records of Los Angeles County, California; EXCEPTING THEREFROM the East 54.71 feet; ALSO EXCEPTING THEREFROM the South 40 feet; that said cash payment and deed shall constitute the total consideration for the purchase of said property; and that when any reputable title company in Orange County, California can issue its policy of title insurance showing said property to be vested in the City of Anaheim free and clear of all en- cumbrances, except all general and special taxes for the fiscal year 1955 -56, and taxes which are not yet due, including special district levies, payment of Lich is included therein and collected therewith, and subject to covenants, conditions, restrictions, reservations, rights, rights -of -way, and ease- ments of record, if any, that the deed tendered by said owners to the City of Anaheim shall be recorded and such policy of title insurance shall be issued, and the purchase price of 2,760.00 in cash, and the deed hereinabove described, shall be turned over to the owners of said property. BE IT FURTHER RESOLVED that the sellers shall pay the usual and customary sellers' charges for furnishing a policy of title insurance necessary to show title vested in the City of Anaheim, as herein provided, and that the City of Anaheim shall pay the usual buyer's charges in the pur- chase of said property.
