1955-2711RESOLUTION NO 2711 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING VARIANCE NO. 283 WITHOUT PREJUDICE TO RESUBMIT FOR A DIFFERENT LOCA- TION. WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition from the property owner of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: That portion of the South half of the Northwest quarter of Section 22, Township 4 South, Range 10 West, S.B.B. M., described as follows: Beginning at a point on the Westerly property line of Harbor Boulevard, that point of begin- ning being South 0° 12 00" East 673.65 feet; thence South 89 48' 00" West 50 feet from the intersection of Harbor Boulevard and Winston Road; thence South 0° 12' 00" East 215 feet; thence West 125 feet; thence North 24° 20' 18" East 235.97 feet; thence East 27 feet to the point of beginning; AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said petition on February 7, 1955, notices of which said public hearing were duly given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code; and fIEREAS, said Commission, after due inspection, investigation and studies made by itself and in its behalf and after due consideration of all evidence and reports of- fered at said hearing, did adopt its Resolution No. 75 Series 1954 -55 recommending to the City Council of the City of Anaheim that Variance No. 283 be granted upon the condi- tions stated in said resolution; and WHEREAS, upon receipt of said resolution from the City Planning Commission, the City Council did duly hold and conduct a public hearing as provided by law, and after due investigation and consideration of evidence and reports, the City Council does find that: 1. There is no substantial property right possessed by other property in the same vicinity and zone and denied the subject property. 2. It appears that the subject property can be adequately developed and used under the present zone. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission granting Variance No. 283, requesting permission to build a deluxe service station upon the above described parcel of land, near the entrance to the parking area of Disneyland, Inc., uaon the conditions stated in said Resolution No. 75 of the City Planning Commission, be, and the same is hereby, reversed, and that Variance No. 283 be, and the same is hereby, denied without prejudice to resubmit for a differ- ent location. -1- THE FOREGOING =SOLUTION is si ;Red and approved by me this 12th day of April, 1955.
