1955-2710and hEsoLulio 1 2710 A RESOLUTION CF THE CITY COUNCIL OF THE CITY OF ANAHEIM aRANTINcl A SPECIAL USE PERMIT FOR THE CONSTRUCTION AND •AINTEN- ANCE OF A HOSPITAL AT LA PALMA AVENUE AND WEST STREET IN THE CITY OF ANAHEIM. WHEREAS, on the 31st day of January 1955, the City Planning Commission of the City of Anaheim did receive an application from L. F. Buchanan, authorized agent of owners and tentative purchaser of 5.9 acres at the Northwest corner of La Palma Avenue ana West Street in the City of Anaheim, for a special use Permit to erect ana operate a hospital, doctors' office ana Pharmacy at saia location, and WHLREAS, said Planning Commission did thereupon give Legal notice that it would hold a public hearing in the Council chambers of the City hall of the City cf Anaheim on Monday, Feb- ruary :1, 1955, at the hour of 2:00 o'clock P.M. to review said application for said proposed use, and notifying all interested persons to attend said hearing and express opinions for or against the granting 01 said special use permit, and did cause said notice to be published on said February 12, 1955, and did cause notice thereof to be given by mailing a postal card notice not less than ten (10) days prior to the date of such hearing to the owners of property within a r:dius of 300 feet of the exterior boundaries of the property for which such special use permit was requested, using for that purpose the last known name and address of such owners as shown upon the assessment roll of Orange County, which said. postal card did contain information as to the time and place where said hearing would be held and the ourpose of said hearing, and notifying all persons interested therein to appear and express opinions either for or against the granting of said special use permit, and WHER':AS, on said 21st day of February, 1955, the City Planning Commission did hold and conduct a public hearing upon said application for said special ese oermit and C1Ci receive evidence and reports from all persons who appeared at said meeting and offered evidence or expressed opinions, and WHEREAS, said meeting was thereupon continued to the 7th day of March, 1955, at which time said. City Planning Commission did thereupon adopt its Resolution No. 105, Series 1954-55, recommending to the City Council of the City of Anaheim that a Specie I Use Permit be granted, subject to: 1. The deeding of 20 feet along West La Palma Avenue for street widening; 2. The deeding of 5.25 feet along North West Street for street widening; 3. The filing of precise plans for the hospital and other buildings reduired for the off-street parking. :iHEREAS, upon receiving said recohedendation, the City Council aid fix the 12th day of April 1955 as the time and place for a public hearing to hear and consider said application for a Special Use Permit and to hear and consider all evidence and reports submitted and opinions expressed by all persons interested in the granting or the denial of said application for said Special Use Permit ana did cause notice -1- thereof to be given by the publication of a notice not less than five (5) days prior to the date fixed for said hearing and caused notice to be mailed to the owners of property within a radius of 300 feet of the exterior boundaries of the property for which such Special Use Permit w as requested, using for that purpose the last known name and address of such persons, as shown upon the assessment roll of Orange County at least 10 days prior to thethte of such hearing, which said notices contained informa- tion as to the time and place of the holding of said public hearing and the purpose for which said hearing was to be held and notifying all persons who were interested therein to appear and present evidence and express opinions thereon, and WHEREAS, the City Council finds, after a careful consideration of all the evidence and reports, and opinions expressed, both for and against the granting of said Special Use Permit, that said Special Use Permit should be granted upon the terms and conditions hereinafter set forth. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a Special Use Permit be and the same is hereby granted to Dr. Louis H. Kolker and Associates for the construction and maintenance of a hospital at the Northwest corner of North La Palma Avenue and North West Street in the City of Anaheim, on approximately 5.9 acres located at said place, upon the following express conditions: 1. That a plot plan showing the number and size of rooms and the proposed uses of rooms be submitted to the City Council of the City of Anaheim for its approval; 2. That a statement of the kind and character of equipment and facilities to be installed and used in said hospital and a statement of the method of operation of said hospital be submitted to the City Council, all of which shall meet the standards of a Class A hospital; 3. Than an artist's rendering or perspective of all buildings shall be submitted, showing elevations; 4. That a faithful performance bond in the amount of $75,000, in favor of the City of Anaheim, be executed and delivered to the City of Anaheim within thirty (30) days from date hereof, conditioned for the commencement of the construction of said hospital within six (6) months from date hereof, in accordance with plans and specifications approved by the City Council; 5. The execution of a 100% faithful performance bond and a 100;0 labor and material bond conditioned for the faithful performance and completion of the contract for construction of said hospital building and the equipment thereof within a period of eight (8) months from the time of commencement of construction thereof, which said bonds shall be executed by the principal, and a corporate surety satisfactory to the City of Anaheim, and conditioned for the payment of the principal sum or so much thereof as may be necessary, to the City of Anaheim for the comple- tion and construction of equipment of said hospital, and the payment of all labor and material charges or liens thereon; -2- 6. That all buildings be set back a minimum of 60 feet from the front property line; 7. That a statement be furnished to the City Council explaining participation of local doctors; 8. That the approximate cost of said hospital shall be $75Q;009; 9. That said use permit and all documents required to be submitted as herein provided shall be submitted to the Administrative Officer and the City Attorney for their recommendation before said Use Permit shall become effective; 10. That all of said documents, information and state— ments, and the performance bond for $75,000, shall be furnished to the City Council on or before thirty (30) days from date hereof; 11. That in the event of the failure to comply with any of the foregoing requirements to the satisfaction of the City Council within said thirty (30) days, or such further time as the Council may grant, then said Special Use Permit shall become null and void.
