1955-2678RESOLUTION NO. 2678 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE MAYOR AND THE CITY CLERK TO ENTER INTO AN AGREEMENT WITH THE STATE OF CALIFORNIA, DEPARTMENT OF PUBLIC WORKS, DIVISION OF HIGHWAYS, FOR THE CONSTRUC- TION BY THE STATE OF AN INVERTED SIPHON STORM DRAIN UNDER THE SANTA ANA FREEWAY AT BROADWAY STREET; AND AUTHORIZING THE CITY AUDITOR TO DEPOSIT THE ESTIMATED COST THEREOF WITH THE STATE. WHEREAS, the State of California, by and through its Department of Public Works, Division of Highways, pro- poses to construct a portion of the Santa Ana Freeway through the City of Anaheim; and WHEREAS, the City desires to have the construction of an inverted siphon storm drain under the freeway at Broad- way Street included in the State contract for the freeway improvement; and WHEREAS, the State of California, Division of High- ways, has offered to enter into an agreement with the City whereby the State agrees to construct said inverted siphon storm drain on the condition that the City assumes responsi- bility for furnishing the necessary funds for the construction of said storm drain and deposits with the State the estimated cost of said proposed work, which is as follows: Unit Quantity Unit Item Price 258 L.F. 48" R.C. Sub -total Contingencies 5% Engineering 10% Total Amount 7,224.00 700.00 725.00 618.00 18.00 200.00 6.00 120.00 224.00 9,835.00 492.00 10,327.00 1,033.00 11,360.00 AND WHEREAS, the City does find and determine that the construction of said inverted siphon storm drain is neces- sary and desirable, and for the best interests of the City, and that the estimated cost thereof is reasonable and not disproportionate to the value of said project. -1- NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANAHEIM that the agreement this day submitted, in triplicate counterparts, to the City Council of the City of Anaheim by the State of California, Division of Highways, dated March 22, 1955, whereby the State agrees to construct said inverted siphon storm drain under the Santa Ana Freeway at Broadway Street, upon the terms and conditions set forth in said agreement, be, and the same is hereby approved; d that the Mayor and the City Clerk be, and they are hereby, authorized and directed to execute said agreement for and on behalf of the City of Anaheim. AND BE IT FURTHER RESOLVED that upon the execution of this agreement by the Mayor and the City Clerk, the City Auditor of the City of Anaheim be, and she is hereby, author- ized and directed to deposit the sum of Eleven Thousand Three Hundred Sixty Dollars 011,360) with the State, said sum being the estimated cost of said project and the amount required to be deposited by the terms of said agreement.
