A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM
AUTHORIZING THE PURCHASE AND ACQUISITION OF CERTAIN REAL
PROPERTY FOR PUBLIC PURPOSES.
WHEREAS, Joe Y. Mendez and Vera Mendez are the owners of the
hereinafter described real property situated in the County of Orange, State
of California; and
WHEREAS, the owners of said property have offered to sell the same
to the City of Anaheim for the sum of Twenty Thousand Four Hundred Dollars
($20,400.00); and
WHEREAS, the City Council does find and determine that public
convenience and necessity require the acquisition of said parcel of real
property; that said property is needed for public use; and that the price
which the owners thereof are willing to accept is reasonable and not out
of proportion to the reasonable market value of said property.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Anaheim that the offer of Joe Y. Mendez and Vera Mendez to sell that certain
real property situated in the County of Orange, State of California described
as follows, to wit:
The westerly half of the northerly half of the easterly
half of Lot 9 of Anaheim Extension as shown on a map
thereof, made by William Hamel, on file in Los Angeles
County, California.
The east of said lot above referred to, being described
as beginning at the northeast corner of said lot and
running thence south to the southeast corner of said
lot; thence westerly along the south line of said Lot,
8 chains; thence at right angles northerly 25 chains,
more or less, to the north line of said Lot; thence
easterly 8 chains, more or less, to the point of begin-
ning, EXCEPTING therefrom the north 264 feet.
for the sum of Twenty Thousand Four Hundred Dollars ($20,400.00) cash, law-
ful money of the United States be, and the same is hereby accepted; and that
the deed tendered by said owners be accepted subject to the terms and condi-
tions hereinafter stated.
BE IT FURTHER RESOLVED that the City Treasurer be, and he is hereby
authorized to deposit in escrow with All Service Corporation, 211 East Center
Street, Anaheim, California, the sum of Twenty Thousand Four Hundred Dollars
($20,400.00), the purchase price of said property; that when any reputable
title company in Orange County, California can issue its policy of title
insurance showing said property to be vested in the City of Anaheim, free and
clear of all encumbrances, except the second half of the general and special
taxes for the fiscal year 1954 -55 and taxes which are not yet due, including
any special district levies, payment of which is included therein and collected
therewith and subject to covenants, conditions, restrictions, reservations,
rights, rights -of -way, and easements of record, if any, that said deed tendered
by said owners shall be recorded and such policy of title insurance shall be
issued showing said property vested in the City of Anaheim as hereinabove
specified; and that the purchase price shall be thereupon paid to the owners
of said property.

AND BE IT FURTHER RESOLVED that the seller shall pay the usual and
customary seller's charges for furnishing a policy of title insurance neces—
sary to show title vested in the City of Anaheim as herein provided, and that
the City of Anaheim shall pay the usual buyer's charges in the purchase of
said property.
THE FOREGOING RESOLUTION is approved and signed by me this 22nd.
day of March 1955.

Anaheim, held on the 22nd day of March 1955, by the following

Van Wagoner.
NOES: COUNCILMEN: None.
AND I FURTHER CERTIFY that the Mayor of the City of Anaheim approved
and signed said Resolution on the 22nd day of March 1955.
