1955-2636RESOLUTION NO. 2636 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING AND AUTHORIZING THE EXECUTION OF AN AGREEMENT TO BE MADE AND ENTERED INTO BY AND BETWEEN SOUTHERN PACIFIC RAILROAD COMPANY, A CORPORATION, AND SOUTHERNV PACIFIC COMPANY, A CORPORATION, GRANTING TO THE CITY OF ANAHEIM AN EASEMENT FOR THE DRAINAGE OF TRACT NO. 2152 IN THE CITY OF ANAHEIM. WHEREAS, Tract No. 2152 is situated in the City of Anaheim and is being developed at the present time, and it is necessary to establish streets in said tract and provide for the drainage of storm and surface waters from said tract; an d WHEREAS, it is necessary and desirable to construct, reconstruct, maintain and use a storm drain beneath the track of Southern Pacific Railroad Company and its lessee, Southern Pacific Company, and in and along that certain strip of land ten (10) feet in width, situate partly within and partly with- out the City of Anaheim, in the County of Orange, State of California, being a portion of the Southern Pacific Railroad Company's land (60 feet wide) described in deed recorded April 14, 1897 in Deed Book 34, Page 108, and in deed recorded October 6, 1896, in Deed Book 29, Page 86, in the Office of the Recorder of said County, and lying equally 5 feet on each side of the following described center line: Commencing at the point of intersection of the westerly prolongation of the center line of Crone Avenue, 60 feet wide, as shown on map of Tract No. 1514, Miscellaneous Maps Book 47, page 30, in the office of said recorder, with the cen- ter line of the Southern Pacific Railroad Company's land (60 feet wide), said center line of land being also the westerly boundary of the City of Anaheim, as shown on said map of Tract No. 1511)1; thence North 0° 10' 08" West, along last said center line, 755.37 feet; thence South 89 49' 52,E West, 30 feet, to a point in the westerly line of said Railroad Company's land, and being the True Point of Beginning of the center line to be described; thence North 89° 49' 52" East, 60 feet, to a point in the easterly line of said Railroad Company's land. The side lines of the above described strip of land terminate in the westerly and easterly lines of land of said Southern Pacific Railroad Company. Said strip of land contains an area of 600 square feet, more or less. AND WHEREAS, the Southern Pacific Railroad Company, a corporation of the States of California, Arizona and New Mexico, and its lessee, Southern Pacific Company, a corpora- tion of the State of Delaware, have this day submitted to the City of Anaheim, in triplicate counterparts, a proposed agree- ment to be made and entered into by and between said Southern -1- Pacific Railroad Company and the Southern Pacific Company granting to the City of Anaheim an easement for the purpose aforesaid, and setting forth the terms and conditions upon which said easement shall be granted, constructed, recon- structed and maintained upon the property hereinabove de- scribed; and WHEREAS, the City Council does find that said agreement is fair upon its face and to the advantage and for the best interest of the City of Anaheim, and that the acquisition of said easement is necessary to provide proper drainage of storm and surface waters from said Tract No. 2152. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the agreement this day submitted, in triplicate counterparts, to the City Council of the City of Anaheim by the Southern Pacific Railroad Company and the Southern Pacific Company, granting to the City an easement and right to construct, reconstruct, maintain and use a storm drain beneath the track of railroad of said Southern Pacific Railroad Company and Southern Pacific Company and in and along that certain strip of land ten feet in width situated partly within and partly without the City of Anaheim, in the County of Orange, State of California, as more particularly hereinabove described, upon the terms and conditions as set forth in said agreement, be, and the same is hereby, approved and accepted by the City Council. AND BE I`1' FURTHER RESOLVED that the Mayor and the City Clerk be, and they are hereby authorized and directed to execute said agreement for and on behalf of the City of Anaheim.
