1955-2634RESOLUTION N0. 2634 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM REVERSING THE ACTION OF THE CITY PLANNING COMMISSION, AND DENYING APPLICATION FOR VARIANCE NO. 279 REQUESTING PERMISSION TO ERECT TWO, 1- STORY, 3 OR 4 -UNIT APARTMENTS ON TWO LOTS AT THE EXTENSION OF CAMBRIDGE STREET IN THE CITY OF ANAHEIM. WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition from the owner of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: That portion of Lot 27, Anaheim Extension, as shown on a map of survey made by William Hamel in 1868 and filed in the Office of the County Recorder of Los Angeles County, California, described as follows: Beginning at a point in the Northerly line of said lot, said point being in the center line of Vermont Avenue (formerly Broad Street) and distant Easterly, measured along said center line, 762.09 feet from the intersection of said center line of Vermont Avenue with the center line of Palm Street, said point of beginning being the Northeasterly corner of the land de- scribed in Certificate of Title No. 7155; thence Southerly along the Easterly line of the land described in said Certificate of Title and along the most Easterly line of the 22.8053 acre tract described in Certificate of Title No. 6539, to a point in the South line of said Lot 27 in the center line of Ball Road, which said point is distant East 775.85 feet from the intersection of the center line of Palm Street and Ball Road; thence East along the center line of Ball Road to the Southeast corner of said Lot 27; thence Northwesterly along the Easterly line of said Lot 27 to the Northeast corner of said lot in the center line of Vermont Avenue, and thence Southwesterly along said center line to the point of beginning. EXCEPTING therefrom that portion thereof lying within Lemon Street. ALSO EXCEPTING therefrom that portion thereof lying Southerly of a line drawn Easterly across said land parallel with the Northerly line of said Lot 27 from a point North 15 24' West 1242 feet from the Southwest corner of said land. ALSO EXCEPTING therefrom that portion thereof lying Northerly of a line drawn Easterly across said land parallel with the Northerly line of said Lot 27 from a point North 15° 24' West 1342 feet from the Southwest corner of said land. -1- AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on January 17, 1955, notices of which said public hearing were duly given as required by law and the pro- visions of Section 9200.17 of, the Anaheim Municipal Code; and WHEREAS, said City Planning Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. 70 Series 1954 -55, granting Variance No. 279 upon the con- ditions stated in said resolution; and WHEREAS, thereafter, within twenty (20) days from the date of the adoption of said resolution, written appeals were filed with the City Council of the City of Anaheim opposing the granting of said variance, and said appeals were set for public hearing on the 8th day of February, 1955, at 8 :00 o'clock P.M. at the City Hall in the City of Anaheim, and notice of such public hearing was duly given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code; and WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence and reports offered at said hearing, the City Council does find and deteittiine that: ATTEST: 1. There is no substantial property right possessed by other property in the same vicinity and zone and denied the subject prop erty. 2. It appears that the subject property can be adequately developed and used under the present zone. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission granting Variance No. 279, requesting permission to erect two, 1- story, 3 or 4 -unit apartments on two lots at the extension of Cambridge Street, in the City of Anaheim, be, and the same is hereby, reversed, and said variance is hereby denied.
