1954-2589RESOLUTION NO. 2589 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE MAYOR AND THE CITTY CLERK TO ENTER INTO AN AGREEMENT WITH SOUTHERN PACIFIC COMPANY GRANTING TO THE CITY A LICENSE TO CONSTRUCT, RECONSTRUCT, MAINTAIN AND OPER- ATE A 42 -INCH CONCRETE PIPE STORM DRAIN, FOR CONVEYING WATER, BENEATH PROPERTY OF SOUTHERN PACIFIC COMPANY AT OR NEAR THE WEST ANAHEIM STANTON STATION. WHEREAS, the City of Anaheim is constructing a 42 -inch concrete pipe storm drain in the City of Anaheim and it is necessary to construct said storm drain beneath the railroad and right -of -way of the Southern Pacific Com- pany at or near the West Anaheim- Stanton Station, in the location as shown in red on a print of Los Angeles Division Drawing A -3928, Sheet No. 1 of 1, Revised November 2, 1954, attached to and made a part of a proposed agreement this day submitted to the City Council by the Southern Pacific Company; and WHEREAS, it is necessary to obtain a license and a permit from Southern Pacific Company, a corporation, to construct said storm drain beneath the railroad and right of -way of said Company at or near said West Anaheim Stanton Station; and WHEREAS, the Southern Pacific Company has offered to enter into an agreement granting to the City of Anaheim a permit and license to construct, reconstruct, maintain and operate a 42 -inch concrete pipe storm drain for conveying water, conforming to said Company's Drawing CS- 1741, attached to and made a part of said proposed agreement above mentioned, said storm drain to be constructed beneath property of said Southern Pacific Company at a depth specified by said Company, at or near the West Anaheim- Stanton Station in the location above mentioned; and WHEREAS, the City Council does find and determine that said permit and license are necessary and that said agreement should be made and entered into with said Southern Pacific Company. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that that certain agreement dated November 16, 1954, to be made and entered into by and be- tween the Southern Pacific Company, a corporation, and the City of Anaheim, granting to the City of Anaheim a license and permit to construct, reconstruct, maintain and operate a 42 -inch concrete pipe storm drain, for conveying water, con- forming to Southern Pacific Company's Drawing CS -1741 at- tached to and made a part of said agreement, said storm drain to be constructed beneath property of said Company at a depth specified by it, at or near West Anaheim Stanton Station in the location as shown in red on the print attached to and made a part of said agreement, be and the same is hereby approved; and the Mayor and the City Clerk be, and they are hereby, authorized and directed to execute said agreement for and on behalf of the City of Anaheim. -1- THE FOREGOING RESOLUTION is signed and approved by me this 30th day of November, 1 954.
