1954-2584RESOLUTION NO. 2584 A RESOLUTION OF THE CITY COUNCIL OF TIE CITY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY AND THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED TO ACCOMPLISH SAID CHANGE OF ZONE. WHEREAS, the City Planning Commission of the City of Anaheim has heretofore duly passed and adopted a resolu- tion recommending denial of a change in the boundaries of the zone or zones hereinafter mentioned and described, after having fixed a time and place for the holding of a public hearing thereon in the manner and as prescribed in Article IX, Chapter 2 of the Anaheim Municipal Code, and after having duly held and conducted such public hearing to con- sider said proposed change of zone or zones and after having received evidence and reports from persons interested therein; and WHEREAS, within a period of forty (40) days follow- ing the hearing thereon, the Planning Commission did duly announce by formal resolution its findings of facts and de- clare its opinions and reasons for recommending a denial of said proposed change in the boundaries of the zones or zones hereinafter mentioned and described; and WHEREAS, within twenty (20) days following the announcement of the action of the City Planning Commission, an appeal was filed with the City Council of the City of Anaheim by owners of properties in the zone or zones upon which said hearing for reclassification was held; and WHEREAS, upon receipt of the report and recommenda- tion of the City Planning Commission and the appeal from said property owners, the City Council did thereupon fix the 23rd day of November, 1954 as the time and the Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed change of zone or zones, and did give notice thereof in the manner and as provided in said Article IX, Chapter 2 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did thereupon consider the recommendations of the City Planning Commission; and WHEREAS, the City Council does find and determine that the property and area proposed to be changed from the zones in which it is now situated to different zones, as hereinafter set forth, is more suitable for the zones to to which it is proposed to change said property and area, and that the inclusion of said property and area in such new zones will increase the value of said property and area and will not depreciate the values of property in adjoining zones. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that all of the property and area -1- situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: The area along the east side of South Los Angeles Street between Los Angeles Street and the first alley east, and from East Vermont Avenue south to the present Com- mercial Zone north of Ball Road, which point is approximately 785 feet north of said Road, be changed from the present classification of R -3, MULTIPLE FAMILY RESIDENTIAL ZONE, and R -A, RESIDENTIAL- AGRICULTURAL ZONE, to the following zones upon the conditions hereinafter set forth: 1. A P -L, PARKING LANDSCAPING ZONE, sixty (60) feet in depth; 2. At the rear of the P -L, PARKING LANDSCAPING ZONE, a 0 -1, NEIGHBORHOOD COMMERCIAL ZONE, extending to the alley, upon the following conditions: (a) That all plans and specifications for buildings to be erected on the property shall be subject to approval of an Architectural Committee consisting of the following: 1. One representative of the owners, their heirs or assigns. 2. One representative of the City appointed by the City Council. 3. An architect or designer designated by the owner or purchaser. This committee shall review the plans and specifi- cations for structural requirements, architectural design, building locations, parking facilities, and other matters included within the deed re- strictions, and one set of plans shall be signed by each of the Architectural Committee and filed with the Building Inspector of the City of Anaheim. (b) That all buildings with 9,000 square feet or over under one roof shall be masonry or similar fire resistant materials. All other buildings shall comply with Fire Zone No. 2 requirements. (c) That the architectural design must be such that the buildings will retain a definite character in keeping with each other. (d) That no building shall be used for residential purposes unless rezoned. (e) That a minimum of 75% of the said property, ex- clusive of streets, is to be maintained for cus- tomer and service parking. ATTEST: (f) That no wall or fence shall enclose any portion of the customer parking area to the exclusion of adjacent parking areas. (g) That these restrictions shall expire on March 1, 1979. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby, authorized and directed to prepare and sub- mit to the City Council an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to amend said Anaheim Municipal Code to accomplish the object herein found and determined to be necessary and proper.
