1954-2554RESOLUTION NO. 2 55Lf A ::ESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ACKNOWLEDGING RECEIPT OF A PETITION FOR THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY TO THE CITY OF ANAHEIM, DESIGNATING THE TERRITORY AS THE MAGNOLIA- CRESCENT ANNEXATION; DE,LCRIBING THE BOUNDARIES OF THE TERRITORY PROPOSED TO BE ANNEXED AND GIVING NOTICE OF THE DAY, HOUR AND PLACE WHERE AND WHEN ANY PERSON OWNING REAL PROPERTY WITHIN SUCH TERRITORY SO PROPOSED TO BE ANNEXED MAY APPEAR BEFORE THE CITY COUNCIL AND SHOW CAUSE WHY SUCH TERRITORY SHOULD NOT BE ANNEXED TO THE CITY OF ANAHEIM. WHEREAS, the City Council of the City of Anaheim dice on the 9th day of November 19 .54 receive a written petition asking that certain new territory described ir.. :aid petition be annexed to the City of Anaheim; and WHEREAS, before the filing of said petition, the pro posal for the annexation of the territory hereinafter described to the City of Anaheim was submitted to the Boundary Commissios of the County of Orange, State of California, and reported upon by said Boundary Commission with respect to the definiteness and certainty of the proposed boundaries; and WHEREAS, said territory proposed to be annexed to said City of Anaheim is situated in the County of Orange, State of California, and is contiguous to the City of Anaheim and is un- inhabited territory, and said petition contained a description of said territory in words and figures as hereinafter in this Resolution described; and WHEREAS, the City Council finds from evidence and re- ,)orts received that at the time of the filing and receipt of sah, petition, it was and now is signed by owners of not less than one- fourth of the area and not less than one-fourth of the assessed valuation of the land in such territory proposed to be annexed, according to the last preceding equalized county assess- ment roll; and WHEREAS, the City Council finds from evidence and re- ports received and from said petition that at the time of the filing and presentation of said petition that said new territory proposed to be annexed to said City of Anaheim did not form a part of any municipal corporation and that said territory was un- inhabited and is contiguous to the City of Anaheim; and WHEREAS, the City Council finds from said petition and evidence and reports received that the boundaries of the territory so proposed to be annexed to the City of Anaheim are as follows, to wit: A parcel of land being a portion of Section 7, Township 4 South, Range 10 West, San Bernardino Base and Meridian, and Section 12, Township 14. South, Range 11 West, San Bernardino Base and Meridian, and more particularly described as follows: Beginning at the most northeasterly right -of -way corner of Magnolia Avenue (60 feet wide) and Crescent Avenue, said point also being an angle -point in the existing Anaheim City Limits Line as established by the Gilbert Street Annexation to the City of Anaheim, Annexation No. 37, as passed by Ordinance No. 868 on November 24 1953 and filed with the Secretary of State on January 11, 1954; thence, 1. Northerly along easterly right -of -way line of said Magnolia Avenue and a xisting Anaheim City Limits Line to an angle point in said existing Anaheim City Limits Line; thence 2. Westerly along said existing Anaheim City Limits Line and crossing said Magnolia Avenue to an angle point in said existing Anaheim City Limits Line said point also being the southeasterly corner of the NW 1/4 of the NE 1 /4 of the NE 1/4 of Section 12, TL.S, R11W, SBB&M; thence, 3. Continuing westerly along the southerly line of said NW 1 /4 of the NE 1/4 of the NE 1/4 of Section 12, T1l.S, R11W, SBB&M to the easterly line of the Southern California Edison Company right -of -way (265 feet wide); thence, 14.. Southerly along said easterly right -of -way line of Edison Company to the northerly right -of -way line of said Crescent Avenue; thence, 5. Easterly along said northerly right -of -way line of Crescent Avenue to the westerly line of the SE 1/4 of the SE 1/4 of the NE 1/14. of Section 12, T4S, R11W, SBB&M; thence, 6. Northerly along said westerly line to the northwest corner of said SE 1/4 of the SE 1/4 of the NE 1/4 of Section 12, T4S, R11W, SBB&M; thence, 7. Continuing northerly along the westerly line of the NE 1/4 of the SE 1/4 of the NE 1/I4. of Section 12, T!{.S, R11W, SBB&M to the northerly line of the S 1/2 of said NE 1 /4 of the SE 1/4 of the NE 1/14. of Section 12, T1r.S, R11W, SBB&M; thence, 8. Easterly along said northerly line to the westerly right -of -way line of said Magnolia Avenue; thence, 9. Southerly along said westerly right -of -way line of Magnolia Avenue to the most northwesterly right -of -way corner of said Magnolia Avenue and said Crescent Avenue; thence, 10. Easterly along the easterly prolongation of the northerly right -of -way line of said Crescent Avenue and crossing said Magnolia Avenue to the point of beginning. TT IT T NOW, _.i!��.RE CRE, BE Il RESOLVED 1 THE CITY COUNCIL .i..._ THE CITY OF A:' A'_E1:`_: That such proposed annexation be designated as "MAGNOLIA- CRESCENT ANNEXATION," and that notice of such pro- posed annexation be and the same is hereby given; and E IT FURTHER RESOLVED that the 14th day of December 19 5 at the hour of 8:00 o'clock P at the City Council Chamber in the City Hal. l of the City of An heim, be and the scree is hereby fixed as the day, hour and place when and where any person owning real property within said terri- tory so proposed to be annexed, and having any objections to the proposed annexation, may appear before the City Council of the City of Anaheim and show cause why such terri ery should not be so annexed; that all persons having, any objections to such pro posed annexation are Hereby notified to appear on said day at said hour and p=lace to show cause, if any they have, why such territory should not be so annexed; and E IT FURTHER RESOLVED that the City Clerk be, and he ie hereby, authorized and directed to cause a copy of this Resolution to be published at least twice, but not oftener than once a week, -3-, in a newspaper of general circulation, published in the City, to wit: The Anaheim Bulletin of Anaheim, Orange County, California, and also in a newspaper of general circulation, published outside of the City, but in the County of Orange, in which is located the territory hereinabove proposed to be annexed to the City of Ana- heim, to wit: The Cypress Enterprise That such publication shall be corn1eted at least twenty (20) stays prior to the date of hearing hereinabove specified. AND BE IT FURTHER RESOLVED that the City Clerk of the City of Anaheim be, and he is hereby, authorized and directed to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed, in the last equalized county assessment roll available, on the date the proceedings were initiated, at the address shown on said assessment roll or as known to said City Clerk, and to any person who has filed his name and address and the designation of lands in which he has any interest, either legal or equitable, with said Clerk: That in the event that land within the territory proposed to be annexed to the City of Anaheim is owned by a County, the City Clerk of the City of Anaheim shall also cause written notice of such proposed annexation to be mailed to the Board of Supervisors of such County. The foregoing notices shall be given not less than twenty (20) days before the first public hearing on the proposed annexation.
