1954-2513RL_SCLUTION NO. 2 5 1 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY CF ANAHEIM. FINDING AND DETERMINING THAT A CHANGE OF ZONE 13 NECESSARY IN CERTAIN AREAS OF THE CITY AND THAT ARTICLE IX, CHAPTER 2 OF THE ANA HEIM MUNICIPAL CODE SHOULD BE AMENDED TO ACCOMPLISH ,AID CHANGE OF ZONE. WHEREAS, the City Planning Commission of the City of Anaheim had heretofore duly passed and adopted a resolution de- claring its intention to change the boundaries of the zone or zones hereinafter mentioned and described and did fix a time and place for the holding of a public hearing thereon in the manner and as prescribed in Article IX, Chapter 2 of the Anaheim Muni- cipal Code, and did duly hold and conduct two public hearings to consider such proposed change of zone or zones and did receive evidence and reports from persons interested therein; and WHEREAS, within a period of forty (40) days following the final hearing thereon, the Planning Commission did duly announce by formal resolution its findings of facts and declare its opinions and reasons for recommending an amendment to said Article IX, Chapter 2 of the Anaheim Municipal Code to effect the proposed changes of the boundaries of the zone hereinafter i :en- t ioned and described; and 1:,'H ER AZ, upon receipt of the report and recommendation of the City Planning Commission, the City Council did thereupon fix the 24th day of August 19_54_, as the time and. the Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed change of zone and did give notice thereof in the manner and as provided in said Article IX, Chapter 2 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did thereupon consider the recor_<,rlendations of the City Planning Commission; and WHEREAS, the City Council does find and determine that she property and area proposed tc be changed from the zone in which it is now situated to a different zone as hereinafter set forth, is r,ore suitable for the zone or zones to which it is proposed to change said property and area and that the inclusion of said pro- perty and area in such new zone or zones will increase the value of said property and area and will not depreciate the values of property in adjoining zones. NOW, T: J!~._J IT RESOLVED by the City Council_ of the City of Anaheim that all of the property and area situated in. the City of Anaheim, County of Orange, State of California, de-- scri4ed as follows, to wit: The area bounded by Manchester Avenue, Euclid Avenue, Crescent Avenue and Loara Street, more particularly described as follows: -1- That portion of the West half of the Southwest quarter of Section 9, Township L}. South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, Partly in the City of Anaheim, and all in the County of Orange, State of California, as the said West half of the Southwest quarter of Section 9 is shown on a map marked Exhibit "A" and attached to the original Complaint, Case No. 41023, Superior Court of the State of California, in and for the County of Orange, de- scribed as follows: Beginning at a point on the West line of said Section 9, North 0° 43 28" West 567 feet from its intersection with the Northeasterly line of the Southern Pacific Railroad Company's 100 -foot right -of -way; thence at right angles North 89° 16' 32" East 30 feet; thence South 23° 13' 28" East 68.88 feet; thence South 45° 43' 28" East 99.98 feet to the beginning of a curve concave to the Southwest and having a radius of 92 feet; thence Southeasterly 72.26 feet along said curve to a point of tangency with a line parallel with and easterly 1 54 feet from said West line of Section 9; thence South 0° 4 28" East 84.23 feet along said parallel line to the North line of the Southwest quarter of the Southwest quarter of said Section 9 and being the North line of the land described in deed to Wm. Koerner, recorded April 6, 1892 in Book 53, Page 244 of Deeds of said Orange County; thence Easterly along said Northerly line to the Northeast corner of said Koerner land; thence Southerly along the Easterly line of said Koerner land to a line parallel with and 481.42 feet Southerly (measured along the Easterly line) of the said Northerly line of the Southwest quarter of the Southwest quarter of said Section 9; thence Easterly along said last mentioned parallel line to the East line of the said West half of the Southwest quarter; thence Northerly along said last mentioned Easterly line to the Northeast corner of the said West half of the Southwest quarter of Section 9; thence Westerly along the Northerly line of said Southwest quarter to the Northwest corner thereof; thence South 0° 43' 28" East along said West line to the point of beginning. EXCEPT THEREFROM that portion described as follows: Beginning at the Northeast corner of the Northwest quarter of the Southwest quarter of said Section 9; thence Southerly 40 feet along the East line of said Northwest quarter; thence at right angles Westerly 20 feet; thence at right angles Southerly 10 feet; thence at right angles Easterly 10 feet; thence at right angles Northerly 10 feet. be changed from a p R -A, RESIDENTIAL- AGRICULTURAL Zone to a 0-2, GENERAL COMMERCIAL Zone, BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby, authorized and directed to prepare and submit to the City Council an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to amend said Anaheim Municipal Code to accomplish the object herein found and determined to be necessary and proper.
