1954-2491WHEREAS, the City Council of the City of Anaheim
did cause to be published in a newspaper of general circula-
tion, printed, published and circulated in the City of
Anaheim, to wit: The Anaheim Bulletin, on the 29th day of
July and the 3rd day of August, 1954, a notice inviting
sealed proposals for the furnishing to the City of Anaheim,
in approximate quantities, of the following reinforced con-
crete cylinder pipe and fittings, including rubber gaskets
for installation:

AND WHEREAS, said notice did provide that said pipe
and fittings shall be in accordance with and conform to
Federal Specifications SS -P -00381 of April 2, 1953, and said
pipe shall be Class 150 for 150 lbs. maximum water working
pressure; and
WHEREAS, such notice inviting sealed proposals for
said reinforced concrete steel cylinder pipe and fittings,
including rubber gaskets for installation, did provide that
said sealed proposals would be received by the City Council
of the City of Anaheim at the Office of the City Clerk of
said City up to the hour of 8:00 o'clock P.M. on Tuesday, the
10th day of August, 1954 for the furnishing to the City of
Anaheim of said pipe, fittings and gaskets; and

CITY OF ANAHEIM ACCEPTING SEALED PROPOSAL
AND AWARDING CONTRACT TO THE LOWEST RE-,
SPONSIBLE BIDDER FOR THE FURNISHING TO THE
CITY OF ANAHEIM OF REINFORCED CONCRETE
STEEL CYLINDER PIPE AND FITTINGS FOR USE
BY THE WATER DEPARTMENT.

AND WHEREAS, the City Council did thereupon submit all
bids received to the City Engineer and the Superintendent of
Light, Water Power of the City of Anaheim for tabulation and
report to the City Council, and said City Engineer and Super-
intendent having tabulated said bids and having submitted their
report, the City Council does find that the sealed proposal of
UNITED CONCRETE PIPE CORPORATION, 14041 Arrow Highway (P. 0.
Box 425), Baldwin Park, California, is the lowest responsible
bid for the furnishing of reinforced concrete cylinder pipe and
fittings, including rubber gaskets for installation, as specified
in the notice inviting sealed proposals and in accordance with
the specifications set forth in said notice inviting sealed
proposals, and that said proposal of United Concrete Pipe
Corporation should be accepted and a contract awarded to said
Corporation for furnishing the pipe, fittings and gaskets re-
quired by the City of Anaheim; and
WHEREAS, the Superintendent of Light, Power and Water
has recommended to the City Council that Item No. 2 mentioned
in the notice inviting sealed proposals be eliminated in the
purchase of said reinforced concrete steel cylinder pipe and
fittings and that the sealed proposal of United Concrete Pipe
Corporation for the furnishing of Items Nos. 1, 3, L4., and 5
mentioned in the notice inviting sealed proposals be accepted and
that a contract be awarded to said United Concrete Pipe Cor-
poration for the furnishing of said pipe and fittings mentioned
in said Items Nos. 1, 3, L4., and 5.
NOW, THEREFORE, BE IT RESOLVED by the City council
of the City of Anaheim that said proposal submitted by the
United Concrete Pipe Corporation for the furnishin g of rein-
forced concrete cylinder pipe and fittings, including rubber
gaskets for installation, as specified in Items Nos. 1, 3, L., and
5 of the notice inviting sealed proposals therefor, and in
accordance with and in conformity to Federal Specifications
SS -P -00381 of April 2, 1953 and conforming to pipe of Class 150
for 150 lbs. maximum water working pressure, be, and the same is
hereby, accepted and that a contract for the furnishing of said
pipe, fittings and gaskets be, and the same is hereby, awarded
to said United Concrete Pipe Corporation; and
BE IT FURTHER RESOLVED that the award of a contract to
said United Concrete Pipe Corporation is declared to be for the
approximate quantities set forth in the notice inviting sealed
proposals for Items Nos. 1, 3, 4, and 5; an d
BE IT FURTHER RESOLVED that said United Concrete Pipe
Corporation be, and it is hereby, required to execute a contract
for the furnishing of said pipe, fittings and gaskets, in form
satisfactory to the City of Anaheim and upon the terms and
conditions specified in the notice inviting sealed proposals,
the proposal submitted by it, this Resolution, and in accordance
with the specifications for concrete steel cylinder pipe and
fittings as set forth in said notice inviting sealed proposals,
in all required sizes and lengths, at the prices as follow:

AND BE IT FURTHER RESOLVED by the City Council of
the City of Anaheim that said bid be, and the sane is hereby,
accepted and said contract awarded for the above specified
reinforced concrete steel cylinder pipe, including rubber
gaskets for installation, and fittings, F.O.B. point of ship-
ment, with freight allowance to trenchside, Anaheim, Cali-
fornia, sad pipe, fittings and gaskets to be delivered as
follows:
The design and layout drawings to be presented
within two weeks from receipt of plans and profile, and
deliveries of said pipe and fittings to commence thirty -five
{35} days after approval of layout drawings and to be com-
pleted within twenty -five (25) days thereafter; and
BE IT FURTHER RESOLVED that the Mr or and the City
Clerk of the City of Anaheim be, and they are hereby, author-
ized and directed to execute for and on behalf of the City
of Anaheim with said United Concrete Pipe Corporation, a
written contract for the furnishing of said concrete steel
cylinder pipe, fittings and gaskets as hereinabove set forth,
and in accordance with the specifications therefor set forth
in the notice inviting sealed proposals and the terms of this
Resolution, and the form of contract approved by the City
Attorney of the City of Anaheim; and
BE IT FURTHER RESOLVED that said contract shall con-

tain a provision that should said United Concrete Pipe
Corporation fail or neglect to furnish said concrete steel
cylinder pipe, gaskets and /or fittings in accordance with said
specifications and the proposal submitted by it and accepted by
the City of Anaheim within the time herein specified, it shall,
in addition to any other penalties provided in the contract
documents, be liable to the City of Anaheim for all loss or
damage that the latter may suffer on account thereof.
THE FOREGOING RESOLUTION is signed and approved by
me this 10th day of August, 1954.
