Street, Susanne Street, Florence Avenue, Charlotte Avenue, South Philadelphia Street and the alley in the City of Anaheim, said improvement to be known and hereinafter designated as Sever Assess- ment cnt J? stri( u 1954 -1; and TITHER?AS, purse iit to the provisions of Section 5701 of said "Improve- ment Act of 1911", it has been recommended by the City Administrator of said city that a registered civil engineer be appointed, to be known as "Ens,.i!]ecr of Work", other than. the City Engineer or in place of the City Engineer, for the purpose of preparing surveys, maps, dra=crin s, piens, profiles an speci.ficnitions for the constructio: of said, sanitary sewers under said act ±tiithiri said Sewer Asses`ement District 1954 1. IT0 i, TH R0'_t?, BE IT RESOLVED by the City Council of the City of Anaheim, California, as follows: S EC` iCF 1.. T iat J. Lester Boyle, n civil engineer registered under the la‘ :s of the State of California as civil en ineer and having his office and principal place of business at 327 Spu Building, Santa Ann, California, be, and he is hereby appointed En, of v;ror" in e above mentioeed matter, to take charge of and perfect such engineerin and incidental work as hereinafter provided for. SECT n 2. That t}'e said. J. H. Lester Foyle shell do or cause to be done and performer all. necessary and proper en gineeri?1 work, such as makin- ,rr 1 of p; pans` drat�rin.=•s profiles, r c' i on s surveys, preparation Q maps, plans, eSt1J'h S� if C1t estimating costs, co:.riputin" bids, supervision and inspection of cofstructlon, That such services shall also include tire furnishing of all office and field. enP supplies and equipment required in connection with the per- formance of the duties of suchEn` -inner of Work, tote t he n with transportation and testing of material, whenever ne ^ess? used in i cons' ru of said improvenieat; That the said services shall also include the furnishing of four (L) complete sets of plans and specifications covering said improvement without any additional charse to said city, and all additional plans and specifications shall be paid for by the Assessment District at the actuc cost to the said Engineer of Work plus the sum of ten per cent (10 a) of such cost. SECTION 3. That the compensation of said J. R. Lester Boyle for the performance of the duties of such En_;ineer of Work, as herein provided, is hereby fixed at an amount equal to fifteen per cent (15) of the total construction cost for said improvement, which compensation shall_ be included as incidental expense and become a char :;e against the special assessment district; for said improvement. Pay mei: t of such compensation shall be made as follows: An amouss.t equal to nine per cent (94) of the estimated bid_ price for said construction cost shall be collected from the contractor as incidental ex=pense and shall be paid to and said J. R. Lester Boyle within fifteen. (15) lays from the date of si nine the contract for such improvement; the balance, or final payment of said compensation, of 155 of the total construction cost sh, li be due and payable to the said J. R. Lester Doyle within fifteen (1) days after the re- cordation and delivery of the assessment and warrant to the contractor or his assignee by the Superintendent of Streets of said city, less any sun of money theretofore advanced to said. J. R. Lester Doyle as partial Payment for suSIl engineering service. SECTION 4. That in the event any of the proceedings initiated for said improvement cease cr are aba d.oned before the comnencerent of construction, th.e city of Anaheim sh ^.11 be lia1)ie for the time and_ expenses actually incurred by the said J. R. Lester Doyle upon the foliowinp; rates for each class or type of workman required to perform such services, to -wit: For the personal services of J. R. Lester Boyle 7 50 per hour For each assistant engineer 5.50 per hour For each deslgr engineer 5 25 per hour For each draftsman 4 50 per hour For each engineering party of three (3) men 15.00 per hoar :For each stenographer and typist 2.00 per hour In addition to the above rates for ens services and wo in- cidental thereto in the event of such abandonment, the said. city of Anaheim shall pay to the said J. R. Lester Foyle for the acttal cost plus 10 of any and. all supplies and materials furnished by him, together with automobile allowance at the rate of seven cent (70) per mile in connection with the performance of engineering services under this Resolution of Appointment, which amount shell be submitted to this City Council by an itemized sworn statement of such services and expenses and shall be prepared, presented and. audited in the same manner as demands upon the funds of said city. AID BE IT FLIRT= RESOLVED that, pursuant to the provisions of Sections 5283 and 5284 of said °Improvement Act of 1911” of said Code, the construction of said sanitary sewers an appurtenant work in connection therewith ,!ithin said.. Assessment District 1954 1 shall be done under the direction and to the satis- faction of said Enginer of Work and. that the materials used shall comply zith the specifications and be to the satisfaction of such Engineer of Work instead of the City Engineer and/or Superintendent of Streets of said city, and that the said Engineer of :Tork shall sign and file the assessment or assessments at the coma plstion of the work instead of the Superintendent of Streets of said city pro- vided, however, that, the contract to be entered into for the construction such improvement shall be sined by the Superintendent of Streets of said city and that when the assessment for said improvement is confirmed by the City Council of said city, the said Superintendent of Streets shall attach a warrant to said assessment bearing the date of such confirmation and record the said assessment, diagram and warrant in his office. A] BE IT FURTHER RESOLTO that the City Clerk of said city is hereby directed to certify and deliver a copy of this resolution to said J. R.
