A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEll1 AUTHORIZING THE PURCHASE AND
ACQUISITION OF CERTAIN REAL PROPERTY FOR
PUBLIC PURPOSES.
WHEREAS, A.E. Arnold and Charles B. Frank are the
owners of the hereinafter described real property situated in
the City of Anaheim, County of Orange, State of California;
and
WHEREAS, said owners have offered to sell said prop-
erty to the City of Anaheim for the sum of Five Hundred Seventy-
four and 88/100 Dollars ($574.88) oash, lawful money of the
United States; and
WHEREAS, the City Counoil does find and determine
that public convenienoe and necessity require the purohase and
acquisition of said parcel of real property for publio purposes,
and that the prioe which the owners thereof are willing to ac-
cept is reasonable and not out of proportion to the fair market
value of said property;
NOW, THEREFORE, BE IT RESOLVED by the City Counoil
of the City of Anaheim that the offer of A. E. Arnold and
Charles B. Frank to sell said property, situated in the City of
Anaheim, County of Orange, State of California, described as
follows, to wit:
The southerly 35.93 feet of the northerly 300
feet, measured to the center line of Center
Street, of Lot 4 as shown on a map of a "Part
of the West 1/2 of Lot 9 of Anaheim Extension,"
located in the City of Anaheim, County of
Orange, State of California, as shown on a map
thereof filed in Book 1, page 53 of Records of
Survey, Records of said Orange County;
EXCEPTING THEREFROM the easterly 57.45 feet.
for the sum of Five Hundred Seventy-four and 88/100 Dollars
($574.88), cash, lawful money of the United States, be, and
the same is hereby, accepted subjeot to the terms and oondi-
tions hereinafter stated.
BE IT FURTHER RESOLVED that the Mayor of the City
of Anaheim be, and he is hereby, authorized for and on behalf
of the City of Anaheim to sign escrow instructions for the
purchase of said real property and to enter into an escrow
with the owners of said property at Bank of Amerioa National
Trust and Savings Association, 150 East Center Street,
Anaheim, California.

AND BE IT ~~RTHER RESOLVED that the City Treasurer
be, and she is hereby, authorized to draw from the Park Site,
Playground and Recreation Fund and deposit in escrow at said
Bank of America National Trust and Savings Association,
the sum of Five Hundred Seventy-four and 88/100-------------
Dollars ($574.88) oash, lawful money of the United States, to

be paid to the owners of said real property when a deed oon-
veying said property to the City of Anaheim, free and clear
of all enoumbrances, except all general and speoial taxes for
the fiscal year 1956-57, and taxes whioh are not yet due, in-
cluding special distriot levies, payment of which is included
therein and collected therewith, and covenants, conditions,
restriotions, rights, rights-of-way and easementsof record,
oan be recorded and a policy of title insurance issued by any
reputable title oompany in Orange County, California, showing
said property vested in the City of Anaheim.
AND BE IT FURTHER RESOLVED that the sellers shall
pay the usual and customary sellers' charges for furnishing a
polioy of title insurance necessary to show title vested in
the City of Anaheim, as herein provided, and that the City of
Anaheim shall pay the usual buyer's charges in the purChase
of said property.
THE FOREGOING RESOLUTION is approved and signed by
me t his 27th day of Maroh, 1956.

NOES: COUNCILMEN: None.
ABSENT: COUNCILMEN: None.
AND I FURTHER CERTIFY that the Mayor of the City of
Anaheim approved and signed said resolution on the 27th day
of March, 1956.
