56R-3189 RESOLUTION NO. 3189 "'''"'' ~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE CITY OF ANAHEIM TO ENTER IN~O A LEASE WI~H THE ANAHEIM UNION HIGH SCHOOL DISTRIOT FOR THE. LEASING OF CERTAIN PARK AND RECREATIONAL FACILITIES FOR THE USE OF THE HIGH SCHOOL ATHLETIC AND RECREATIONAL PROGRAM. WHEREAS, heretofore, to wit, on the 1st day of July, 1955, the Anaheim Union High Sohool Distriot made and entered into an agreement with the City of Anaheim to jointly organize, promote and conduot a program of oommunity reore~ tion during the fisoal year 1955-1956, for general eduoational and recreational objectives for the children and adults of said City and said School Distriot to promote and preserve the health and welfare of the people of the City and the ohildren of said Sohool Distriot; and WHEREAS, by the terms of said agreement the Anaheim Union High Sohool Distriot did agree to pay the City of Anaheim the sum of ~hirt;y-f1ve Thousand Nine Hundred Ninety-four Dollars ($35,994) as the Sohool Distriot1s share of the expense of the maintenanoe of said reoreational facilities; and WHEREAS, the Anaheim Union High Sohool Distriot did receive therefor the right and privilege of using said public parks and reoreational facilities of the City of Anaheim, excepting the municipal plunge; and WHEREAS, said School District has used the La Palma Park and the La Palma Park recreational facilities under said joint program; and WHEREAS, the City of Anaheim oontemplates the ereotion and construotion of a steel-deck grand stand, with a seating oapacity of approximately 7,100 persons, to be ereoted and oonstruoted in La Palma Park, in the City of Anaheim; and WHEREAS, the Sohool Distriot is desirous of having the use of said La Palma Park faoilities, and partioularly the use of said football field and grand stand faoilities in said park; and WHEREAS, the Board of School Trustees of the Anaheim Union High Sohool Distriot has found and determined that it would be to the advantage and for the best interest of said School Distriot to obtain the use of said park and park reoreational facilities under a lease extending over a term of years; and ,~- WHEREAS, the City Council does find and determine that it would be to the advantage and for the best interest of the Oity of Anaheim to enter into a lease to lease the use of said facilities to the Anaheim Union High Sohool Distriot and to obtain rental over a fixed term of years to aid the City in recovering the cost of constructing said steel-deck grand stand. -1- - r NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a lease be made and entered into with the Anahe:im Union High School District of the City of Anaheim for the leasing by the City to said School District of La Palma Park recreational facilities, including said grand stand, for a term of four (4) years, commenoing on the 1st day of July, 1956, and ending on the 30th day of June, 1960, at an annual rental of Thirty-two Thousand Five Hundred Dollars ($32,500), lawful money of the United States, payable as follows: The sum of $16,250 on the 1st day of January, 1957; and The sum of $16,250 on the 1st day of June, 1957; and The sum of $16,250 on the 1st day of January and the 1st day of June of each year thereafter during the term of said lease, for the use of said facilities for the High Sohool athletic activities, football games, and recreational aotivities; and that the Mayor and the City Clerk be, and they are hereby, authorized to make and enter into a lease with the An~~eim Union High School District for the leasing of said faoilities upon the terms and conditions herein mentioned. AND BE IT FURTHER RESOLVED that it is understood and agreed by the City Counoil of the City of Anaheim that the use of said faoilities given and granted to the Anaheim Union High Sohool District by said lease is not an exclusive use, but is to be a joint use with the City of Anaheim, but that the High Sohool District is to have the use of said faoilities upon the dates when high sohool football games and high school baseball games are scheduled and upon such other dates as shall be arranged with the City upon an annual schedule. AND BE IT FURTHER RESOLVED that any lease made and entered into by and between the City of Anaheim and the Anaheim Union High Sohool District shall provide that the Sohool Dis- trict shall have an option to renew said lease for an additional term of six (6) years at the rental of Ten Dollars ($10) per year, and that at the expiration of said six (6) year term, the School District shall have an option to renew said lease for an additional term that may be mutually agreed upon between the parties hereto and upon a rental mutually agreed upon.
