RESOLUTION NO. 1188
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM AUTHORIZING THE PuRCHASE
AND ACQUISITION OF CERTAIN REAL PROPERTY
FOR PUBLIC PURPOSES.
WHEREAS, public convenienoe and necessity require
the purchase and aoquisition of real property for public
purposes, to wit: Off-street parking purposesj and
WHEREAS, notice of the time, plaoe and terms of
sale of the hereinafter desoribed real property was duly
given by the Guardian of the Person and Estate of Maggie
Wommer Adams, Incompetent, owner of said propertYj and
WHEREAS, the City Council did find and determine
that a bid should be submitted for the purohase of said real
property for use by the City of Anaheim for off-street park-
ing purposes; and
WHEREAS, an offer to purchase said property for
the sum of $25,500 was submitted to said Estate of Maggie
Wommer Adams, Incompetent, and said offer was accompanied
by a deposit in the sum of $2,550 as evidenoe of good faith
and as required by law; and
WHEREAS, an order confirming the sale of said
property to the City of Anaheim for the sum of $25,500 was
made by the Court, and the City of Anaheim has been requested
to enter into escrow with said Guardian of the Person and
Estate of Maggie Wommer Adams, Inoompetent, at All Servioe
Corporation, Anaheim, California, for the completion of said
sale.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of An~~eim that the City aocept a conveyanoe of
said property situated in the City of Anaheim, County of
Orange, State of California, described as follows, to wit:

Lots 53 and 55 in Vineyard Lot "E 5," in the
Langenberger Tract in Anaheim, Orange County,
California, as shown on a Map reoorded in
Book 1, pages 551 and 552 of Miscellaneous
Reoords of Los Angeles County, Californiaj
EXCEPTING THEREFROM the easterly 6t feet and
the southerly 20 feet as oonveyed by Emma
Anna Dunn and Robert Dunn, her husband, to
the City of Anaheim, by deeds recorded in
Book 13, page 114 and in Book 144, page 4 of
Deeds, records of Orange County, California.
TOGETHER WITH all the tenements, hereditaments
and appurtenanoes to the same belonging or in
anywise appertaining.
for the total sum of $25,500, lawful money of the United
States, $2,550 of whioh amount has heretofore been deposited
with said estate, leaving a balance of $22,950 to be paid
into escrow, subjeot to the terms and conditions hereinafter
stated.

BE IT FURTHER RESOLVED that the Mayor and the City
Clerk of the City of Anaheim be, and they are hereby, author-
ized for and on behalf of the City of Anaheim to sign escrow
instructions for the purchase of said real property, and to
enter into an escrow with the Guardian of the Person and
Estate of Maggie Wommer Adams, Incompetent, owner of said
property, at All Service Corporation, 211 East Center Street,
Anaheim, California;
AND BE IT FURI'HER RESOLVED that the City Treasurer
be, and she is hereby, authorized to deposit in escrow at All
Service Corporation, Anaheim, California, the sum of $22,950,
being the amount necessary to make up the total oonsideration
of $25,500, the sum of $2,550 having previously been paid to
said estate, said sum to be paid to said estate when a deed
conveying said property to the City of Anaheim, free and olear
of all encumbranoes, except all general and special taxes for
the fisoal year 1956-57, and taxes whioh are not yet due, in-
cluding speoial distriot leVies, payment of whioh is included
therein and oollected therewith, and covenants, oonditions, re-
strictions, reservations, rights, rights of way and easements
of record, can be reoorded and a policy of title insuranoe
issued by a reputable title company in Orange County, Cali-
fornia, showing said property vested in the City of Anaheim.
BE IT FURTHER RESOLVED that the seller shall pay the
usual and customary seller's charges for furnishing a poliey
of title insuranoe neoessary to show title vested in the City
of Anaheim, as herein provided, and that the City of Anaheim
shall pay the usual buyer's charges in the purchase of said
prop erty .
THE FOREGOING RESOLUTION is approved and signed by
me this 20th day of Maroh, 1956.
