RESOLUTION NO. 2437
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM APPROVING AND
AUTHORIZING A REDISTRIBUTION AND ADJUSTMENT. OF
THE PURCHASE MONEY RECEIVED FROM MIDWAY CITY
SANITARY DISTRICT FOR SAL%. TO SAID MIDWAY CITY
SANITARY DISTRICT OF CAPACITY RIGHTS IN THE
MAGNOLIA TRUNK SEWER AND PUMPING PLANT AND FORCE
MAIN.
WHEREAS, heretofore, to wit, on or about the 25th day of April,
1952, the Cities of Anaheim, Fullerton and Orange, and the Buena Park,
Garden Grove, La Habra and Placentia Sanitary Districts made and entered
into an agreement with the Midway City Sanitary District of Orange County,
California, wherein and whereby they did agree to sell and said Midway City
Sanitary District did agree to buy certain capacity rights in Sections A,
B and C of the Magnolia Trunk Sewer and Pumping Plant and Force Main, and
WHEREAS, said Midway City Sanitary District did agree to pay a
certain percentage of the final cost of the construction of said Magnolia
Trunk Sewer and Pumping Plant and Force lviain, together with interest there-
on at the rate of two per cent (2p) per annum from November 15, 1950 to
date of payment of purchase price, which percentage was thereafter deter-
mined to be the sum of 91,069.54, and
WHEREAS, said sum was paid by said Midway City Sanitary District
to the City of Anaheim as contracting agent for said Cities and Sanitary
Districts on or about the 5th day of October, 1953, and was by the City of
Anaheim distributed to said Cities and Sanitary Districts in accordance
with the percentage of ownership and capacity rights owned by them at the
time of such distribution; that at the time of said distribution, said
Cities and Sanitary Districts had not finally determined and adjusted their
percentages of ownership and capacity rights in the Magnolia Trunk Sewer
and Pumping Plant and Force Main and the Luclid Trunk Sewer Line, and
WHEREAS, since said final distribution, said Cities and Sanitary
Districts have finally determined and adjusted their percentages of owner-
ship and capacity rights in said sewage disposal facilities and have duly
made and entered into an agreement under date of April 1, 1954, adjusting,
fixing ana determining said percentages of ownership and capacity rights,

WHEREAS, by reason of said final adjustment and determination of
the percentages of ownership of said Cities and Sanitary Districts in said
aewage disposal facilities, and the changes made by the agreement of April
1, 1954, it is necessary to make a redistribution and adjustment of the
purchase money received from said Midway City Sanitary District upon the
sale of capacity rights in the Magnolia Trunk Sewer and Pumping Plant and
Force Main to said Midway City Sanitary District, and
WHEREAS, the Joint Engineering Committee has computed the redis-
tribution of said purchase money to be made to the several Cities and
Sanitary Districts by the Orange County Joint Outfall Sewer as shown on
Exhibit A hereto attached and made a part hereof, which redistribution has
been approved by the Joint Executive Committee, who have recommended a
redistribution of said purchase money in accordance therewith.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim
from the Midway City Sanitary District of Orange County, California for the
purchase of capacity rights in the Magnolia Trunk Sewer and Pumping Plant
and Force Main, pursuant to the agreement hereinabove mentioned, be redis-
tributed to the several Cities and Sanitary Districts of the Orange County
Joint Outfall Sewer or their present successors in interest, in accordance
with Exhibit A hereto attached.
AND BE IT FURTHER RESOLVED that the City of Anaheim, as contract-
ing agent for said Cities and Sanitary Districts, be and it is hereby
authorized and directed to make said redistribution and adjustment of said
funds in accordance with said Exhibit A.
