56R-3178 -- r"-" RESOLUTION NO. 3178 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 465. WHEREAS, the City Planning Commission of the City of Anaheim did reoeive a petition from the OWDer of certain real property situated in the City of Anahetm, County of Orange, State of California, described as follows: The southerly 57 feet of that portion of Vine- yard Lot G-6, in the City of Anaheim, as shown on a map thereof reoorded in Book 4, Pages 629 and 630 of Deeds, Reoords of Los Angeles County, California, described as follows: Beginning at a point 144.75 feet westerly measured at right angles from the monumented center line of South Palm Street, and 38.25 feet northerly measured at right angles from the monumented center line of West Water Street; thence northerly parallel with said center line of South Palm Street, 513.25 feet to the northerly line of the land con- veyed to Joseph WM. Heinz, et ux., by deed dated November 19, 1925, and recorded in Book 619, Page 4 of Deeds, Records of said Orange County; thence easterly along said northerly line to a point 34.75 feet westerly at right angles from the monumented center line of South Palm Street; thence southerly along a line parallel to said monumented center line of South Palm Street 513.25 feet, more or less, to a point in a line 38.25 feet northerly, measured at right angles from the monumented center line of West Water Street, which line is the northerly line of West Water Street, as fixed by that certain deed recorded January 8, 1927, in Book 10, Page 81, Offioial Recor-ds, in the Office of the County Reoorder of said Orange County; thence westerly, along said northerly line of West Water Street, 110 feet to the point of begin- ning. Said property is located at the Northwest oorner of South Palm Street and West Water Street, and designated as 559 South Palm Street. AND WHEREAS, the City Planning Commission did hold a publio hearing at the City Hall in the City of Anaheim on December 19, 1955, notices of which said pu~ic hearing were duly given as required by law and the provisions of Section 9200.17 of the Anaheim Munioipal Code; and ,.- WHEREAS, said City Planning Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due oonsideration of all evidence and reports offered at said hearing, did adopt Resolution No. 93, Series 1955-56, granting said Varianoe No. 465; and WHEREAS, thereafter, within twenty (20) days from the date of the adoption of said resolution, a written appeal was filed with the City Counoil of the City of Anaheim re- questing a review of the aotion taken by said Planning Com- mission, and said appeal was set for public hearing on the -1- - r 31st day of January, 1956, at 7:00 o'olock P.M. at the City Hall, in the City of Anaheim, and notice of such public hearing was duly given as required by law and the provisions of Seotion 9200.17 of the Anaheim Munioipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City C01JDoil did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard, and did reoeive evidenoe and reports and did thereupon close said hearing and deolare that action would be taken at a later date; and WHEREAS, after due investigation and studies made by itself and in its behalf, and after due oonsideration of all the evidence and reports offered at said hearing held on January 31, 1956, the City Council does find that: 1. There are exceptional or extraordinary circum- stanoes or conditions applioable to the prop- erty involved or to the intended use of the property that do not apply generally to the property or olass of use in the same vicinity and zone. 2. That such a variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vioinity and zone and denied to the property in question. 3. That the granting of suoh varianoe will not be materially detrimental to the public welfare or injurious to the prop erty or improvements in suoh vicinity and zone in which the property is looated. 4. That the granting of suoh variance will not ad- versely affeot the oomprehensive general zoning plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby, granted to W. C. MoCARTHY, D.D.S., 610 California Bank Building, Anaheim, California, to con- struot a professional building, consisting of two units, with the required parking area and offsets, on the above described property, upon the following conditions: 1. That the office hours be limited to 6:00 o'olock P.M., except in cases of emergenoy. 2. That the air oonditioning system or any other equipment, if noisy, be shut off by 9:00 o'clook P.M. r The City Council hereby reserves the right to revoke such variance permit for good oause or failure of said owner or his heirs, successors or assigns to comply with the Anaheim Munioipal Code and regulations, and the conditions herein. -2- /-"\ Said variance is granted for the term presoribed by the Anaheim Munioipal Code unless otherwise specified herein. ,..-..
