56R-3177 -- f RESOLUTION NO. 3177 A RESOLUTION OF THE CITY COUNCIL OF THE. .t!. '. ~~'. OF ANAHEIM FINDING AND DETERMINING THAT .1fQ'. '. CHANGE OF ZONE IS NECESSARY IN CERTAIV A.. . OF THE CITY AND THAT ARTICLE IX, CHAPtE:a-:2 OF THE ANAHEIM MUNI CIP AL CODE SHOULD BE AMENDED TO ACCOMPLISH SAID CHANGE OF ZONE. WHEREAS, the City Planning Commission of the City of Anaheim has heretofore duly passed and adopted a resolution recommending denial of a change in the boundaries of the zone or zones hereinafter mentioned and described, after having fixed a time and place for the holding of a public hearing thereon in the manner and as prescribed in Article IX, Chapter 2 of the Anaheim Municipal Code, and after having duly held and conducted such public hearing to consider said proposed change of zone or zones, and after having received evidence and reports from persons interested therein; and WHEREAS, within a period of forty (40) days following the hearing thereon, the Planning Commission did duly announce by formal resolution its findings of facts and declare its opinions and reasons for recommending a denial of said proposed change in the boundaries of the zone or zones hereinafter mentioned and described; and WHEREAS, upon receipt of the report and recommendation of the City Planning Commission, the City Council did thereupon fix the 13th day of MaroA, 1956, as the time and the Council Chamber in the City Hall of the City of . Anaheim as the place for a public hearing upon said proposed change of zone zones, and did give notice thereof in the manner and as provided in said Ar Chapter 2 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, t City Council did duly hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evida and reports and did thereupon consider the recommendations of the City Plan Commission; and WHEREAS, the City Council does find and determine that the property and area proposed to be changed from the zone in which it is now situated to a different zone, is more suitable for the zone or zones as hereinafter set forth and that the inclusion of said property and area in such new zone or zones will increase the value of said property and area and will not depreciate the values of property in adjoining zones, but that the remaining lots should remain in the zone in which they are now incorporated. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a portion of the property and area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: Lots 136 to 151, both inclusive and Lots 1,32,33 and 62 in Tract No. 1825. (Said tract is located at the Southeast corner of East Romneya Drive and North Street.) ,......, -1- .,. ~,Y$~'~~s-l."::> ,,- be changed from R-l, ONE-FAMILY RESIDENTIAL ZONE, to R-3, MULTIPLE-FAMILY RESIDENTIAL ZONE, upon the conditietlllhereinafter set forth, and that the remainder of 8il.id property remain R-l, ONE-FAMILY RESIDENTIAL ZONE. That the portion to be changed to R-3 and the portion to remain R-l are described as follows: That Lots 136 to 151, both inclusive; be changed to R-3, MULTIPLE-FAMILY RESIDENTIAL ZONE; and That the remainder of subject property, being Lots 1,32,33 and 62, remain R-l, ONE-FAMILY HESIDENTIAL zon, and that said lots 136 to 151, both inclusive, be reclassified subject to the following conditions: 1. That the buildings to be erecte~ on lets l36 to 143, both inclusive, shall be limited to one story in height, and that the buildings to be erected on Lots 144 to 151 both inclusive, shall be limited to two stories in height. 2. That the owner of subject property place of record standard City of Anaheim R- 3 Deed Restrictions, approved by the City Attorney, which restrictions shall limit the buildings erected on Lots 136 to 143, both inclusive, to one-story in height, and shall l1mi t the buildings erected on Lots 144 to 151, both inclusive, to two stories in height. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby, authorized and directed to prepare and submit to the City Council an 8lIIendment to Article IX, Chapter 2 of the Anahem Municipal Code to ..end said Anaheim Municipal Code to accomplish the object herein found and determined to be necessary and proper.
