1954-2410z .SOLUTION NC. 2b1O A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEII4 FINDING AND DETERMINING THAT A CHANGE OF ZONE 13 NECESSARY IN CERTAIN AREA: OF THE CII Y AND TrjAT ARTICLE IX, CHAPTER 2 OF THE ANA-- HEIL MUNICIPAL LODE SHOULD BE AMENDED TO 1- CCOI:IPLISH eAID CHANGE OF ZONE. WHEREAS, the City Planning Commission of the City of Anaheim had heretofore duly passed and adopted a resolution de- claring its intention to change the boundaries of the zone or zones hereinafter mentioned and described and did fix a time and place for the holding of a public hearing thereon in the manner and as prescribed in Article IX, Chapter 2 of the Anaheim Muni- cipal Code, and did duly hold and conduct two nubile hearings to consider such proposed change of zone or zones and did receive evidence and reports from persons interested therein; and WHEREAS, within a period of forty (40) days following the final hearing thereon, the Planning Commission did duly announce by formal resolution its findings of facts and declare its opinions and reasons for recommending an amendment to said Article IX, Chapter 2 of the Anaheim Municipal Code to effect the proposed changes of the boundaries of the zone hereinafter r.:en- tioned and described; and WHEREAS, uoon receipt of the report and recommendation of the City Plannin Commission, the City Council did thereupon fix the 12th day of .Jaauary 19 54 as the time and the Council. Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed change of zone and did give notice thereof in the manner and as provided in said Article IX, Chapter 2 of the Anaheim Municipal Code; any WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did thereupon consider the recommendations of the City Planning Commission; and WHEREAS, the City Council does find and determine that she property and area proposed to be °flanged from the zone in which it is now situated to a different zone as hereinafter set forth, is Bore suitable for the zone or zones to which it is proposed to change said property and area and that the inclusion of said pro- perty and area in ouch new zone or zones will increase the value of said property and area and will not depreciate the values of property in adjoining zones. NOli, 1 FORE, 3E IT tESCLVED by the City Council of the City of Anaheim that all of the property and area situated in the City of Anaheim, County of Orange, Ltate of California, de- scri'aed as follows, to wit: The area bounded by the South side of West Vermont Avenue, the West side of South Los Angeles Street, the North side of Ball Road and the East side of South Lemon Street, be changed from R -A, RESIDENTIAL- AGRICULTURAL ZONE, to the follow- ing zones upon the conditions hereinafter set forth: -1- 1. That the owners of the property deed to the City of Anaheim a strip of land 5.25 feet in depth alon South Lemon Street for future widening of this street, and a strip of land 20 feet in depth along South Los Angeles Str and Ball Road for the future widening of these streets. 2. That a P-L, PARKING-LANDSCAPING ZONE, 60 feet in depth be created along West Vermont Avenue, South Los Angeles Street, Ball Road and South Lemon Street, this P-L Zone to start at the new property lire after allowance for street widening as above mentioned. 3. That the balance of the property be zoned 0-1, NEIGHBORHOOD COMMERCIAL ZONE, upon the following conditions: (a) That all plans and specifications for build- ings to be erected on the property shall be subject to a of an Architectural Com- mittee consistinz, of the following: (g) 1. One representative of the owners, their heirs or assigns. 2. One representative of the City appointed by the City Council. 3. An architect or desip;ner designated by the owner or purchaser. This committee shall review the plans and specifications for structural requirements, architectural design, building locations, parking facilities and other matters in- cluded within the deeC restrictions, and one set of plans shall be signed by each on the Architectural Comelittee and filed with the Buildin; Inspector of the City of Anaheim. (b) That all buildings with 9,000 square feet or over under one roof shall be masonry or similar fire resistant materials. All other buildings shall comply with Fire 'Zone No. 2 requirements. (c) That the architectural design must be such that the buildings will retail] a definite character in keepin with each other, (d) That no building shall be used for residential purposes unless rezoned. (e) That a minimum of 75 of the said property, ex- clusive of streets, is to be maintained for customer and service parking, (f) That no wail or fence shall enclose any portion of the customer parking area to the exclusion of adjacent parking areas. That these restrictions shall expire on March 1, 1979. -2- BE IT FURalf, EES .:LVED that the City Attorney be, and he is hereby, authorized and directed to prepare and submit to the City Council an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to amend said Anaheim Municipal Code to accomplish the object herein found and determined to be necessary and proper.
