1954-2398RESOLUTION NO. 2398 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE JOINT CON- STRUCTION AND INSTALLATION WITH THE STATE OF CALIFORNIA OF A FULL TRAFFIC ACTUATED TRAFFIC CON`_'ROL SIGNAL SYSTEM AND HIGHWAY LIGHTING AT THE INTERSECTION OF EUCLID AVENUE WITH STATE HIGHWAY ROUTE VII -ORA- 178 -ANA (LINCOLN AVENUE) WITHIN THE CITY OF ANAHEIM, AND PROVIDING FOR THE PAYMENT OF A PORTION OF THE COSTS THEREOF BY THE CITY OF ANAHEIM. WHEREAS, the State and the City of Anaheim contem- plate the joint installation of a full- traffic actuated traffic control signal system and highway lighting at the intersection of Euclid Avenue with State Highway Route VII Ora -178 -Ana (Lincoln Avenue) within the City of Anaheim; and WHEREAS, the State and the City desire to enter into an agreement for the construction and installation of said full traffic actuated traffic control signal system and highway lighting and to provide for the maintenance functions that are to be performed by the State and the City, and to specify the proportionate share of the costs that are to be borne by the City and the State, as more particularly set forth in the form of agreement hereto attached and made a part hereof; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the City be, and it is hereby, authorized to enter into an agreement with the State of Cali- fornia in a form hereto attached and made a part hereof, for the joint installation of a full- traffic actuated traffic control signal system and highway lighting at the intersection of Euclid Avenue with State Highway Route VII -Ora- 178 -.na (Lincoln Avenue) within the City of Anaheim upon the terms and conditions set forth in the form of agreement hereto at- tached, and upon the further condition that the contract or contracts for the construction and installation of said full traffic actuated traffic control signal system and highway lighting shall be awarded by the State to the lowest respons- ible bidder, after the publication of a notice inviting sealed proposals therefor, as provided in Chapter 3, Part 5, Division 3, Title 2, Section 14290, and as provided in Sections 37902 and 37903 of the Government Code of the State of Cali- fornia. AND BE IT FURTHER RESOLVED that the City shall pay its share of the costs of construction and installation of said full- traffic actuated traffic control signal system and highway lighting as provided in the copy of agreement hereto attached and estimated to be the sum of rpL,200.00, the actual amount thereof to be determined after award and completion of the construction contract. AND BE IT FURTHER RESOLVED that the Mayor and the City Clerk be, and they are hereby, authorized to execute -1- said agreement for and on behalf of the City of Anaheim, THE FOREGOING RESOLUTION is signed and approved by me this 20th day of April, 1954. CLERK OF THE C A G R E E M E N T The City of Anaheim, a body politic and a municipal corporation of the State of California, hereinafter referred to as "CITY," and the State of California, Department of Public Works, Division of Highways, hereinafter referred to as "STATE," do enter into the following agreement: WHEREAS, the State and City contemplate installation of full- traffic actuated traffic control signal system and highway lighting at the intersection of Euclid Avenue with State Highway Route VII -Ora -178 -Ana (Lincoln Avenue) within the City of Anaheim, and WHEREAS, said parties desire to provide herein for the maintenance functions that are to be performed by the par- ties hereto and to specify the proportionate share of the costs that are to be borne by City and State; NOW THEREFORE, IT IS AGREED AS FOLLOWS: SECTION I For and in consideration of the covenants and condi- tions to be kept and performed by City as set forth herein, State agrees: (a) To furnish traffic control signal system and highway lighting hereinbefore mentioned, through construction by con- tracts with construction contractors licensed by the State of California, said contracts to be carried out in accordance with provisions of the State Contract Act, Chapter 3, Part 5, Divi- sion 3, Title 2 of the Government Code, and to be completed in conformity with plans and specifications of the State of Calif- ornia, Department of Public Works, Division of Highways. (b) To bear entire expense of preparation of plans and specifications, and the State's share of expense of the con- struction engineering, inspection and construction costs to -1- complete the traffic control signal system and highway light- ing referred to herein, such share to be a sum bearing the same proportion to the total cost of installation of signals and highway lighting as the number of highways under juris- diction of State, which may enter the intersection involved bears to the total number of highways entering such inter- section involved bears to the total number of highways enter- ing such intersection. (c) State will maintain and operate the entire traffic control signal system as constructed. (d) To reimburse City for its proportionate share of the cost of general maintenance and operation of said highway lighting in accordance with the terms of that certain agree- ment for maintenance of State Highways within the City of Anaheim effective July 1, 1950, and subsequent amendments thereto. SECTION II For and in consideration of the covenants and con- ditions to be kept and performed by State as set forth in this Agreement, City agrees: (a) To reimburse State promptly upon rendition of state- ment therefor, City's share of expense of the construction engineering, inspection and construction costs, to complete the traffic control signal system and highway lighting re- ferred to herein, such share to be a sum bearing the same proportion to the total cost of installation of signals and highway lighting as the number of highways under jurisdiction of City, which may enter the intersection involved, bears to the total number of highways entering such intersection. It is estimated that the cost of the City's share is '4,200.00, however, the actual amount to be determined -2- after award and completion of the construction contract. (b) City will maintain and operate the highway lighting as constructed. (c) To reimburse State for its proportionate share of the cost of general maintenance and operation of said traffic control signal system, in accordance with the terms of that certain agreement for maintenance of State Highways within the City of Anaheim effective July 1, 1950, and subsequent amendments thereto.
