1954-2392RESOLUTION NO. 2392 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROPRIATING CERTAIN FUNDS FOR ADVERTISING AND PROMOTION OF THE CITY OF ANAHEIM AND AUTHORIZING A CONTRACT WITH THE ANAHEIM CHAMBER OF COMMERCE FOR THE DOING OF SAID ADVERTISING AND PROVIDING FOR COMPENSA- TION TO THE CHAMBER OF COMMERCE FOR SERVICES TO BE RENDERED TO THE CITY OF ANAHEIM. WHEREAS, the Anaheim Chamber of Commerce located within the City of Anaheim has special knowledge, experience and facilities for promotion and advertising work; and WHEREAS, the City Council finds that it would be for the best interest and welfare of the City of Anaheim and the citizens thereof to appropriate funds for the promotion and advertising of the City of Anaheim for the purpose of in- ducing the immigration of industry, business and persons to said City; and WHEREAS, the City Council finds the staging of the Halloween Festival brings many people to the City of Anaheim and has great value in advertising the City of Anaheim; and WHEREAS, the City Council finds that a great deal of work is required to be done in the development and expan- sion of industry and that the Chamber of Commerce of the City of Anaheim is peculiarly fitted and equipped to perform such work and render such services and that it would be to the advantage and best interest of the City of Anaheim to employ the Chamber of Commerce to render said services and to aid in the promotion, advertising and expansion of industry in the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANAHEIM that certain sums of money to aid in the promotion, advertising and expansion of the City of Anaheim be appropriated and set aside for the following purposes, and in the folJowing amounts, to be expended during the calendar year 1 954: For the printing and distribution of maps, pamphlets, brochures and other printed ma- terial and for the collection and dissemina- tion of factual data, information and statistics concerning Anaheim, the sum of For transportation expenses, labor and office expenses in the rendition of services in the development and expansion of industry, the sum of For advertising, publicity and direct mail expenses for aiding in the promotion and the staging of the annual Halloween Festival, the sum of TOTAL 4,000.00 $2,000.00 6,000.00 BE IT FURTHER RESOLVED that the Anaheim Chamber of Commerce be, and it is hereby, employed for the follow- ing purposes and to render the following services: 1. To render services in the development and expansion of industry by obtaining and fur- nishing to the City Council information and data relative thereto. ATTEST: C BE IT FURTHER RESOLVED that the funds hereinabove appropriated and set aside shall be paid out upon demands pre- sented to the City and audited by it as required by law and shall be supported by a statement cf said Anaheim Chamber of Commerce showing the amount of liability incurred as the basis of said claim. That said demands shall be presentee quarterly to the City Council. Any expenses in addition to said amounts set forth herein shall be paid by said Anaheim Chamber of Commerce. AND BE IT FURTHER RESOLVED that the Mayor and the City Clerk be and they are hereby authorized and directed to enter into a written contract with the Anaheim Chamber of Commerce, a copy of which is hereto attached and made a part hereof, for the term July 1st 1954 to June 3oth 195 5 and from month to month thereafter until terminated by written notice by either party. (Copy) A G R E E 14 E N T THIS AGREEMENT made and entered into as of the day of 19511 by and between CITY OF ANAHEIM, a Municipal Corporation, hereinafter designated as "CITY, A N D ANAHEIM CHAMBER OF COMERCE, an Association, hereinafter designated as "ADVERTISER," W I T N E S S E T H: THAT WHEREAS, said Advertiser is the Chamber of Commerce located within the City of Anaheim and has special knowledge, experience and facilities for promotion and advertising work to be done and performed for the City of Anaheim, NOW, THEREFORE, for and in consideration of the promises and agreements herein contained to be done and per- formed by the parties hereto, said parties do hereby agree as follows: That said Advertiser on behalf of the City of Anaheim 1. Render services in the development and expansion of 2. To aid in the staging of the annual Halloween Festival and the decorations, signs and advertising thereof. 4. That said Advertiser hereby agrees to aid in and carry on the work of inducing immigration of industry, business and persons to said City and to furnish information to the public regarding the City of Anaheim and to perform such other services from time to time as the said City may require. That in consideration of services to be performed by said Advertiser, said City hereby agrees to pay certain sums of money in compensation for services rendered and the promotion and advertising of the City of Anaheim as follows, to wit: For the printing and distribution of maps, pamphlets, brochures and other printed material and for the collection and dissemination of factual data, information and statistics concerning Anaheim, the sum of 4.,000.00 For transportation expenses, labor and office expenses in the rendition of services in the development and expansion of industry, the sum of 2,000.00 -1- For advertising, publicity and direct mail expenses for aiding in the promotion and the staging of the annual Halloween Festival, the sum of -o- TOTAL the same to be paid on itemized demands submitted to the City and audited and allowed by said City. Any expenses in addition to said amounts set forth shall be paid by said Advertiser. That in the event said City shall desire any additional services in connection with the programs, events and advertising hereinabove mentioned or in the advertising and promotion of the City, said Advertiser shall upon request of said City itemize the cost thereof and submit the same to the City for approval by the City and said City may modify or alter any such plan in any particular or may reject said plan in its entirety, or may direct the submission of a new plan or proposal which may be accepted, altered or rejected. Upon the final approval of any such plan and the execution thereof by said Advertiser, said City shall pay the cost thereof upon demand of the Advertiser as here- in provided which cost shall not exceed by more than 10% the estimated cost of such plan or proposal as herein set forth, un- less with the express consent of said City. That all money due under said plan or proposal shall be paid upon demands presented to the City and audited by it as required by law and shall be supported by a statement of said Advertiser showing the amount of liability incurred as the basis of said claim. The term of this contract shall be from the 1st day of July 1954 to the 30th day of June 195 5 and from month to month thereafter until terminated by written notice by either party hereto. thirty days' written notice shall be given of the termination of said agreement.
