1954-2342RESOLUTION NO. 2342 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE SALE OF CERTAIN REAL PROPERTY OWNED BY THE CITY OF ANAHEIM TO JAMES S. BEATTIE AND EMILY BEATTIE, HUSBAND AND WIFE, FOR INDUSTRIAL USE. WHEREAS, the City of Anaheim is the owner of the hereinafter described real property; and WHEREAS, said property is no longer needed for municipal purposes; and WHEREAS, on or about the 24th day of/ August, 1953, the City Council adopted Resolution No. 2220 _,ivi.ng and granting to James S. Beattie and Emily Beattie, husband and wife, an option for a term of six (6) month to purchase the hereinafter described property for the sum •f 37.00 per front foot for the Northerly 115 feet ther of, and the sum of j>42.00 per front foot for the Southerl• 42.5 feet thereof, cash, lawful money of the United States, to be paid to the City of Anaheim upon the exercise of sal.: option and delivery of a good and sufficient grant deed con eying said property to said James S. Beattie and Emily Bea tie, husband and wife; and WHEREAS, said James S. Bea tie has notified the City of Anaheim of their election to exer ise said option and has tendered to the City the purchase p ice thereof and requested that the City execute and deliver nto escrow a good and suf- ficient deed conveyin- said property to said James S. Beattie and Emily Beattie, husband and wi e, for the price and upon the terms mentioned in said opti•n. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the sale of the following described real property situated in the ity of Anaheim, County of Orange, State of California, to wit: A tract of land i the City of Anaheim, County of Orange, State qf California, being a portion of the Southwest quarter of the Southeast quarter of Secti•n 3, Township 4 South, Range 10 West, San Be nardino Base and Meridian and more particula y described as follows: Beginning at point on the North line of East La Palma Ave e, which point is 30 feet North of the monum nted center line of said East La Palma Avenu and 30.18 feet East of the monu- mented cent r line of North Olive Street; thence Northwardl' along a line parallel to the monu- mented ce er line of said North Olive Street a distanc of 132.50 feet to the true point of beginnin; thence continulng Northwardly along a line p= rallel to said monumented center line of Nor•tt_ Olive Street a distance of 157.50 feet to a point; thence East along a line parallel to the North line of said East La Palma Avenue -1- a distance of 200 feet to a point; thence Southwardly along a line parallel to the monumented center line of said North Olive Street a distance of 157 .50 feet to a point; thence West along a line parallel to the North line of said East La Palma Avenue a distance of 200 feet to the point of begin- ning. RESERVING to the City of Anaheim an easement for public utilities over, under or across the Easterly five (5) feet of said tract. to James S. Beattie and Emily Beattie, husband and wife, for the sum of 6,040.00 lawful money of the United States, be and the same is hereby approved and authorized; and BE IT FURTHER RESOLVED that the Mayor and the City Clerk be and they are hereby authorized to execute a good and sufficient deed conveying said property to said James S. Beattie and Emily Beattie, husband and wife, subject to covenants, conditions, restrictions, easements, reservations, rights and rights -of -way of record, and to deliver said deed into escrow to be delivered to said purchasers upon the com- pletion of said escrow and the payment of the full purchase price as hereinabove provided; and that the City Clerk be, and he is hereby, authorized and directed to certify a copy of this Resolution and cause the same to be delivered into escrow with said deed, to be filed in the Office of the County Recorder; and BE IT FURTHER RESOLVED that the City pay the usual sellers escrow title and recording expenses, including a commission of to the real estate broker who obtained a purchaser for said property; and BE IT FURTHER RESOLVED that said property shall be and is sold upon the following conditions: 1. That the sum of cash, law- ful money of the United States, shall be de- posited in escrow and paid to the City of Anaheim at the close of escrow; and the sum of cash, to be submitted with said offer to purchase. 2. That said property shall be sold subject to all of the conditions, restrictions, easements, reservations, rights and rights -of -way of record. 3. Said property is sold upon the condition that it is to be used for industrial purposes. 4. That said property is sold upon the condition that it will be improved in accordance with plans and specifications submitted with and accompanying the application to purchase said property, and that if said purchasers shall fail to comply with the conditions herein specified, then title to said property shall revert to the City of Anaheim and the purchase price shall be returned to said purchasers, less any reasonable and necessary expenses that the City has incurred in connection with said sale. -2- 5. That the improvement of said property, as herein specified, shall be commenced within 6 months from date hereof and completed within a reasonable time thereafter.
