A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AUTHORIZING A PARTIAL DISMISSAL
OF THE ACTION ENTITLED uCI~Y OF ANAHEIM VS.
HAGAR, ET AL.," DOCKET NO. 65553, FILED IN
THE SUPERIOR COURT OF THE STATE OF CALIFORNIA
IN AND FOR THE COUNTY OF OIRANGE, INSOFAR AS
IT AFFECTS THAT PORTION OF' PARCEL 9 HEREIN-
AFTER MORE PARTICULARLY DESCRIBED, OWNED BY
CHARLES F. HUGHES AND MELBA K. HUGHES,
HUSBAND AND WIFE.
WHEREAS, heretofore, to wit, on or about the 31st
day of May, 1955, an aotion was oo~enoed in the Superior
Court of the State of California, in and for the County of
Orange, entitled "City of Anaheim, a Munioipal Corporation
of the Sixth Class of the State of Oalifornia, Plaintiff,
vs. George H. Hagar, et al., Defendants," under Docket No.
65553, for the aoquisi tion in eminen,t domain of oertain
real property therein desoribed for the widening and im-
provement of Harbor Boulevard; and
WHEREAS, the defendants, Oharles F. Hughes and
Melba K. Hughes, husband and wife, are the owners of said
property described as Paroel 9 in said oomplaint, and the
defendants, W. C. Mauerhan and Anna Mauerhan, have, or
claim to have, some right, title or interest in and to said
property; and
WHEREAS, the Department of Public Works, Division
of Highways of the State of California, is seeking for State
Highway purposes that portion of Parcel 9 hereinafter more
partioularly desoribed, and has requested that the action
filed by the City of Anaheim hereinabove mentioned be dis-
missed insofar as it affects said portion of Parcel 9; and
WHEREAS, based upon the report of the City
Engineer, the City Council does find and determine that the
portion of Parcel 9 sought by the Division of Highways will
not now be needed by the City of Anaheim for the improvement
and widening of Harbor Boulevard.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the City Attorney be, and he is
hereby, authorized and directed to file a partial dismissal
of the action entitled "City of Anaheim, a Municipal Corpora-
tion of the Sixth Class of the State of California, Plaintiff,
vs. George H. Hagar, et al., Defendants," Docket No. 65553,
in the Superior Court of the State of California, in and for
the County of Orange, insofar as said action affeots the fol-
lowing described portion of Paroel 9 mentioned in said com-
plaint:

Beginning at a 4" x 4" post standing at a point
20 chains south of the quarter seotion corner
of the north boundary of Section 22, Township 4
South, Ran~e 10 West, S.B.B. &: M.; thenoe N.
89. 561 40 E. 54.8 feet to a point; thence
S. 5. 30' 00" W., 30 feet more or less to a point
of interseotion with a line parallel to and 50
feet easterly, as measured at right angles, from

the center line of Harbor Boulevard, said
point of intersection also being the true
point of beginning; thence S. 50 30' 00"
w. a distance of 216.54 feet to a point on
the easterly right of way line of Harbor
Boulevard; thence S. 00 16' 25" E. along
the easterly right of way of said Harbor
Boulevard a distanoe of 235.0 feet to a
point; thenc eN. 80 15' 2611 E. to a point
of intersection with a line parallel to
and 50 feet easterly, as measured at right
angles, from the center line of Harbor
Boulevard; thence N. O. 16' 25" W. along
said line parallel and 50 feet distant
from the center line of s!aid Harbor Boule-
vard to the true point of beginning.
THE FOREGOING RESOLUTION is signed and approved by
me this 28th day of February, 1956.

was passed at a regular meeting of the City Counoil held

ABSENT: COUNCILMAN: Van Wagoner.
AND I F(JRTHER CERTIFY THAT the Mayor of the City
