J. NOBLE OOBfABY, P. O. Box 620, Orange, Oalifornia is the lowest responsible proposal submitted for the furnishing of all plant, labor, servioes, materials and equipment, all utilities and transportation, inoluding power, fuel and water and performing all work necessary to oonstruot and oomplete in a good and workman- lik~ manner in striot acoordanoe with the speoifioations, plans and drawings therefor on file in the offioe of the City Clerk of the City of Anaheim of the public improvement hereinabove mentioned and desoribed, together with the appurtenanoes thereto, and as speeified in the notice inviting sealed proposals, and that said proposal of said above named bidder should be aocepted and a con- tract awarded to said bidder in aooordance therewith; and WHEREAS, the City Counoil finds that the above mentioned sealed proposal is the lowest responsible proposal received and that the person, firm or corporation submitting said proposal is a responsible person, firm or oorporation and that the proposal sub- mitted is the best suited and fitted for the public improvement to be construoted. /r-~ NOW, THEREFORE, BE IT RESOLVED BY 'mE CITY COUNCIL OF THE CITY OF ANAHEIM that the sealed proposal submitted by R. J. NOBLE CO~YJ P.O. BOx 620, Orange, California for the furnishing or all plant, labor, servioes, materials and equipment, all utilities and transportation, including power, fuel and water and pe rforming all work necessary to construct and oom- plete in a good and workmanlike manner, in strict accordance with the speoifications, plans and drawings therefor on file in the offioe of the City Clerk of the City of Anaheim and the notioe in- -2- - ~ vi ting sealed proposals, the public o"orks and ir:.1provements herein... above more particularly mentioned and described, together .li th the appurtenances thcreto,be, and the same is hereby, accepted, and that a contract for t~e construction and completion of said public improvement be, and the same is hereby, awarded to the said above named bidder. AND BE IT FUnTHER RESOLVED that the successful bidder or bidders upon each contract awarded as hereinabove set forth shall be, and they are hereby required to e;;:ecute a contract in the re- quired form with the City of AnaheiQ upon the terms and conditions specified in the notice inviting sealed proposals and the proposal submitted by said successful bidder or bidners and in accordance with the plans and specifications for said public improvement hereinabove described and in accordance with the terms, conditions and provisions of this resolution, and that said successful bidQer or bidders to whom each oontract is awarded shall be required to furnish a surety bond in an amount equal to one hundred per cent (100%) of the contract price for all labor, materials and equipment to be furnished and performed as set forth in the sealed proposals submitted by said bidder for the construction of said public im- provement together with the, appurtenances thereto or such portion thereof as is covered by said contract as seourity for the faith- ful performanoe of said contract and a separate surety bond in an amount equal to one hundred per cent (lO~~) of the construction cost of said public improvement covered by said contract as security for the payment of all persons performing labor and furn- ishing material for said project. AND BE IT FURTHER RESOLVED that said suocessful bidder or bidders be, and they are hereby required to furnish to the City of Anaheim in companies satisfactory to the City of Anaheim public liability, property damage, compensation, and other insur- ance in the amounts and for the purposes as set forth and specified in the notice inviting sealed proposals and subject to .the approval of the City Attorney as to form and sufficiency.
